Long story short, my daughter's 99 tj has this trans. It's got paint marker numbers on it like it was a rebuilt unit. It's always felt tight if that makes sense. When it's cold started and driven it will stall the engine when you come to a stop or even stand on the brake and shift to reverse. Is this a band adjustment issue or torque converter. My knowledge of auto transmissions is limited and I'm trying to figure this out as she's getting annoyed with it. It shifts fine up and down, but at idle its still trying to put a good amount of torque to the wheels. Once warmed up its better. Idle isnt too high to cause it. Whay say ye?

I have had the TPS give similar issues in my 99 xj. worth back probing and OHM the sweep.
 
Have you disconnected the torque convertor connector and taken it for a cold whirl? That should confirm if the TC staying locked is/isn't the issue?
That's a great thought and next on the checklist once the child let's it cool down for a while. Let's say it's still locking then it's definitely the TC, correct? If it doesn't change anything then it's something internal in the transmission? It's done this from day one but seems to be getting slightly worse over the last few years and a lot more of an issue this winter.
