Damn the Bank

So I pull under the Bank drivethrough to make a deposit the other day...The wind blows and the banks ceiling and metal pieces blow out and crash into the side of my car. I talk to the bank manager and he instructs me to get an estimate and they will take care of the damage. Later that evening he tells me the main office says that My insurance should cover it. But my vehicle is payed for and my insurance does not cover that kind of damage that the bank is at fault. The banks insurance has just informed me that it was an "act of God" and they werent to blame either. Thanks alot State Employees Credit Union...

Jeep wrangler. The tiles n stuff almost came through my soft top and if any of them would have made it through and hit my daughter in the back seat it would have killed her i bet.

I got a few scratches dents and dings, and a busted head light from that crap.............I guess i need to go buy a damn head light. Before the great state of NC has one of theyre Dodge Charger driving Knights give me a ticket for a headlight.
 
I wonder if a Rock through the Window of the bank is an "Act of God".I mean God created us in His Image and we all know that God can in fact be "Vengeful".Therefore if you Seek Vengeance against a bank that had a Poorly Constructed Roof,that would be a "Act of God" Right?Maybe I am over thinking it and I am not in any way condoning throwing multiple rocks through the windows of the bank.

Well im in a North Carolina Building Code class right now and Im pretty sure that an outside covering or drivethrough isnt supposed to have Drop ceilings in it? anyone know anything about that? All i know is that if a tree falls outta my yard and into the neighbors house....MY insurance pays for theyre repairs...

Thats something that a single letter from a lawyer ought to correct.

Unless it was a tornado or hurricane, they should have built and/or maintained the structure better. Maybe a too-tall truck or trailer previously hit it and damaged it, and they failed to repair it in a timely manner?

He put me in contact with theyre Insurance company theyre the ones who told me that they were not paying to have it fixed. I asked the woman who i needed my lawyer to contact (of course i havent talked to one yet) But i could tell by her voice it kinda pissed her off. I dont know this is just ridicolous, If i get a lawyer involved it will morethan likely cost as much to get it taken care of than the Bank would end up paying out for whatever the estimate would be. I havent even gotten an estimate because i just knew they were going to try to get out of it.

If you do get a lawyer and go after the bank. With the judgment you should be able to get your court and lawyers fee's covered.

we just went through that at my work a tree on the next lot fell on 2 brand new cars and we had to pay to fix the cars not the owner of the lot it is in the books "act of god" sorry it sucks but it looks like our SOL.

Was this NCSECU? They have a board of directors, and every area has a local advisory board. Maybe time for some letter-writing.

On the lawyer bit...had to get a lawyer to send a letter for me several years ago for a collection. Cost all of fifty bucks. I pretty much had the rough draft...he sent 98% of what I wrote, on his letterhead. It worked.

Damn, thank you for your input man. At least it wasnt alot of damage. But ill definitely be buying some headlights soon.

The NC SECU is the State Employees Credit Union. A bank here. I dont know what to do really.
 
Just remember...it's the insurance company's job to NOT pay claims. Their allegiance is to their stockholders and board of directors...not the policy holders, or owners of property they damage. They say "no" because they know that many people will accept a no answer and move on.
 
When it comes to liability, you have to remember that at the end of the day, it isn't the insurance company that is liable, it's the company (or person). An ins co. is just there to pay up on behalf of the co. so they don't have to. Just b/c the ins company says they won't cover it, doesn't mean that the insured isn't still liable for the damages, it just means it comes out of their pocket. At the end of the day, this is the Bank's problem.
IF you're going to go after somebody and threaten or get a lawyer, the "person" to go after is the Bank. They will either pay up themselves, or force the Ins. Co. to.

Now, personally, my opinion is that unless this is really, clearly something where the Bank did something wrong (e.g. clear gross negligence), I'd chalk this up to "shit happens" and move on with life.
just b/c something isn't "your fault" doesn't mean it really is somebody else's. People can't control nature and shit happens. This is why people continue to pay for comprehensive insurance on their cars, then they don't have to pay out of pocket.
 
At a local McDonalds there were some wild chickens that hung out there. It was always fun to feed them McNuggets. Well one fell out of the tree and scratched the paint on a guys car. He sued them and got money. Now think about that. A wild bird fell out of a tree and scratched a guys car and he got money from it. lol

The next week they hired someone to catch all the wild checkens and remove them.

The bank building was not constructed properly or had poor maintenance if the wind blew parts off. The bank doesn't want bad press. You need to talk calmly and firmly to the bank manager after you have three estimates. If he doesn't pay in a week then sue them for mental anguish also.

Wrong. Once you've banked at the NCSECU, you'll never bank elsewhere.
