Welp, i cant believe i have to make one of these posts, but anyone know a good one? Fiance got pulled at atlantic beach.

48 in a 35 and .16 BAC

I could check the court dockets and see who gets used the most, but does anyone down there have a preferred lawyer?

I'll spare you the whole "So many people walk down the side of the roads near the beach, you could have killed them all" speech.. ;)
 
i wasnt with her. as far as "the speach" goes, you guys dont know how mad i am about this.

First instinct is the let them throw the book at her, but, that probably isnt a wise decision.

I'll check on it. I am not far from there and my wife's family lives there and sister in law has used a couple there too.
 
well, from personal experience, she is going to have to have a breathalyzer(sp?) in her vehicle for a year(if this is first offense)...and have to attend 40 hours of "counseling" which includes several hours of AA...the counseling was even more expensive than my lawyer, and i had a pretty good one. i blew the same thing she did. good luck with everything and pm me if you have any questions about the rundown of what will happen and the steps that will have to be made.

I think that's wrong... I've known people w/ first offenses to get restricted driving privilages, etc... no blow starting the vehicle...

sounds like you may have had a bad attorney...

i actually had a really bad lawyer....i would have had driving priveliges but ended up getting a dwlr right before the court gave them to me, then the ncdmv revoked them.....i actually got off pretty light.....

Not wise at all. NC laws have changed. In the state now .16 is very bad. Beleive me when I say how much this could cost you. Between 3k-5k. You dont want to know the penalties if she gets convicted.
I speak from experience because i had a problem two years ago. Laws changed December 06. Very bad right now. Hopefully she has a clean record because that is the only thing going for her. Check your PM box.
 
Yeah the laws have changed drastically in the last few years after all the reports came out about how many people were getting off with nothing or found not guilty......Its very hard, if not impossible, to get out of a DUI now, even with a good lawyer.
 
Yep, laws changed drastically. Brother in law is just now getting his license back after 3 years without because of 1 underage dui and 2 when he was 21 and 22. Not counting his costs then, but to get his license back, he has to go to several "classes" and some sort of mental therapy/check to see if he is OK to get a license and handle the responsibility, etc. Court and many appeals to even get a work privledge license. And, he has to have the breathalizer in his car for 7 years!!! Yep, 7 years. That is crazy expensive. However, because of his age and not having a license or insurance for such a long time, they are treating him like a new driver, not a DUI driver, so he saves a few $$$ there, but not much.

Let me guess, either she was coming up the beach from Emerald Isle just as you get into Atlantic Beach or coming over the bridge? Those are 2 of the bad spots for cops down there

that is true. However, I knew him in high school and he didn't exactly hang out with the right crowd, etc. However, he is completely different now, married to my sister, has a family, etc.

They say some can't change, I've seen it first hand and how he is realizes his obligations as an adult to support his family.

Knowing him then, not knowing him for 12 years, then knowing him again now when he and my sister started dating, 2 completely different people. Hes changed A LOT!
 
He shouldn't have a car after 3 DUI's.

I have little to no sympathy for anyone that drives drunk.

As far as the courts leiniency goes...some 17 year old kid is one thing, but any adult knows what they are doing, and knows the consequences.
 
I'm not sure how this works to well, but make sure you ask about the "prayer for judgment" free bee that NC gives people...

LMFAO, prayer for judgement for a DUI. Be sure to let us know how that works out.
 
yea, theyll laugh you out of court for pjc for a dui.......intoxilyzer is crazy expensive...200 somethin for install fee and 128 every other month for a "service" fee...not to mention having to drive to the shop that put it in every other month for that "service"...they just plug it into the computer.....and trust me they are a pita to use until you get used to it...make sure your not in a hurry to go anywhere!lol......
 
Better off saving the lawyer money. go pro se and suck it up. She'll need the $5K for fines, fees and insurance surcharges.
