I just learned a lesson the hard way, seems to be my way of life :rolleyes:. Finally got my Jeep off jackstands and off the road for the first time in 10 months. I went out to the local mud hole, and come to find out, from a sheriff, it's private property of Onlsow County. He took my information, radioed the plates in, and said someone will be calling me about my court date soon. He never gave me a ticket or had me sign anything, just said I'll be charged with a misdemeanor. Does that sound right? What should I expect from here? He never saw me tresspassing, just muddy on the side of the road with 2 other guys I met there.

Thing that sucks is, I donate regularly to groups keeping trails open, always leave with more trash than I come in with, and preach about responsibility on the trail and here I am being a retard and not finding out on my own if it's legal or not. . . Damn.

So what now?

OR you may get that call, or a letter. Go to court, pay up and learn the lesson.
 
If he stopped you for being muddy, what's to stop any sheriff from stopping someone that got muddy in URE and claiming they got muddy on private property?

he didn't stop me on the property, but he did take all my info and run my plate, so if he's just trying to scare me-he's doing a hell of a job. I've just never heard of a sheriff saying you'll get a phone call for your court date. No ticket, nothing. I thought that was odd. I suppose if I got the call, and he wasn't just bluffing, I could get a lawyer and say I was just pulled off the side of the road. I just happened to be on the side of the road next to the trail head. . .

I don't plan on ever going back there, I didn't know I was tresspassing. Wish they'd make those signs bigger than big mac box.
 
A) If you don't know who it belongs to, and you've never gotten permission from anybody, and it's just a mudhole off the side of the road, it's probably illegal, and you should find out who it belongs to before going back in.

B) I got the "ticket in the mail" speech when I was 16, after getting pulled for racing a buddy after school. Flagrant violation, honestly, I shoulda gone to jail for that one! However, I guess he was on his way to something else, or just felt lenient, but he told us our tickets were in the mail. I ran straight home after school for two weeks straight to check the mail! No ticket. My understanding is that if you're not issued a ticket on the spot, they don't follow up. You kinda need to sign something for it to be official, I guess. I know that was part of the issue when they started doing the stoplight tickets. No way to prove that it was actually you in the car.

Anyway, I wouldn't sweat it. Don't be a dumbass and go back, though. At least not without doing your research. Who knows, you may be able to get permission to roll there, if you ask nicely. Consider this a lesson learned, and you'll be a big maturity step ahead of most of your peers!
 
No ticket, call you to give you a court date? Sounds like BS to me, if you do get a call about and court date (and you probroly want) go to court with no ticket for trespassing it will get thrown out. I would not worry about it, I have never heard of "we will call you with the court date"
 
i wish i had this guys phone number. it would be awesome to call him from someone elses phone and fukk with him about court dates and fines sometime this week.

I agree 100%. I'm usually the one that goes and finds out exactly what's legal and what's not. I turned a new leaf over 10 years ago and have kept my nose clean since then. It was such a well traveled place, I just let my guard down and went. Lesson learned.

If he didn't catch you on the property then I don't think he can do much of shit. Unless you told him yes I was tresspassing.
 
nope, never said I was on the property. Just said I was unaware it was private land.
 
If I were you I would do one of two things. Either hurry and change your number or just don't answer your phone. Then you can plead ignorance.

I call BS too.

I had the same thing happen to me but the cop was in plain clothes and showed me his badge. I was riding a wheelie on Hwy 70 about 120mph and passed him but got caught at a stop light that's when he showed his badge and told me to pull over and proceeded to give the "I'll give you a call" spill. He was full of more shit than a christmas turkey. The next cop that stopped me meant business a few months later. He whipped out his ticket book and wrote a few good ones. Carless an wreckless W/O regard to others safety, unsafe movement,improper equipment, etc...but a good lawyer got me out of that.

That is not true. If the owner of the land wanted to press charges for trespassing he could do so if the cop gave him your information. He could file a complaint and a warrant could be sent out for OP's arrest. This is definitely a worst case scenario, but just because he didn't get a ticket doesn't mean the owner of the land can't press charges.

they can issue a warrant for your arrest or detainment. at that point you would recieve a phone call asking you to come to the magistrates office, or worse yet, a knock on your door on sunday morning.
 
If you don't confess you were there and he didn't witness you there, then all he can do is suspect you were there. If the judge asks you plead the 5th. With only circumstansial evidence they can't do anything to you.
 
Yeah, without written permission, or it being posted as a park, it's trespassing. So, there's no legal reason for the land owner to need to hang "No Trespassing" signs. We keep that sort of info up in the important information section along with the laws and whatnot.

As far as I can tell, that sounds more like a decent strategy for discouraging trespassers that the cop didn't actually catch trespassing. They'll keep you in mind and on record if there are issues there (drugs found, vandalism, etc.), but they're not likely to do more than that.

You probably won't hear anything back from this. If you do just find out who the better local lawyers are and pay one of them to take care of it for you. By all means you should learn your lesson, but shelling out $400 to help fund a lawyer's new boat is a good way to learn too. If you can avoid it you don't want to be one of those people who has to fill out the section of an employment application that says "Have you ever been convicted of a crime other than a minor traffic violation? If so please explain."
