OBD II engine swap legality?

I've done many trail only and older truck/car engine swaps in the past. But, a customer asked me today if we could keep his TJ street legal and swap in a late model V-8 drivetrain. Most likely a 5.0 Explorer engine/trans. I know he can get away with it for another year or so in Jones County, but is it possible to get such a swap to pass an emissions inspection?
 
Last I checked, it had to be the same year or newer engine with all emissions equipment operating and all of the OBD 2 readiness tests had to run and pass. As far as which emissions standards it has to pass(explorer or TJ) I don't know. Like I said, I haven't checked in a while and the law may have changed.
 
Technically no. You might be able to get by with using a chrysler v-8 since the emissions that the motor and the vehicle would require would be the same or extremely similiar. One problem would be that the vin and mileage that shows up in the computer won't match the vin and mileage that is on the jeep so it'll get flagged in the system and possibly get the shop audited if you inform the shop doing the inspection ahead of time that the computer has been swapped and give them the vin off the computer that should keep them out trouble if the dmv questions it. I'll check my DMV book in the morning and see exactly what it says.

That's what I was thinking, I appreciate you checking since I don't keep a copy of the book handy. Maybe I could talk him into a 5.9 out of a Dakota if I can weasle around the emissions standards with it. :driver:
