happens all the time
there's so many cases of companies "borrowing" pictures from the internet for use.....most of the time, calling them and asking them to take it down does nothing since there's no copyright or anything...and then even if it IS copy written...they can change enough small things and still use it.
 
yeah but that would not/will not look good spreading like the flu on all the jeep and 4x4 forums
 
Lol thats pretty funny. I know NAXJA used the quadratec jeep for there hoodies and all, just did some very minor changes.

Probably bescause Rustys stuff sux, everything I bought from them and raced either broke or had some sort of problem. Couldnt get anybody to own up to having their stuff so they borrowed someones pic
 
It does happen all the time. A few years back I had a company post pictures of my 98 TA on their website and claimed they had done the work to it. Really pissed me off because I had done every single thing on the car myself in my garage.

They took it down and apologized, but I was still pretty hot. They went out of business within a year.
 
well I have met Rusty and his son and they were very nice guys.. and to be honest I would find it hard to believe they would do that..

so I went and searched and the found that the pic that is in the guys profile does not even match this ZJ pic on rustys site,

sure doe snot look like the same jeep to me.

I think he is just starting trouble.. and no I do not have time to sign up on another site and start and argument..
 
so i kept reading a post by him that was 54 pages long and found he did buy a new rig like the one on rustys site

but i still find it hard to believe they would find a pic and then fake it..
 
I'd be pissed for sure...
and tell them they can either take it down w/in 24 hours or expect the lawsuit for my royoalties from the revenue generated by using your image.
 
Maybe the previous owner of the rig posted it ? But I do concure that Rusty's stuff sucks.Well let me rephrase that back in 2004 their xj parts sucked thats all I can speak for.
 
I'm going to post all of your rigs from the build section on Rusty's site and wait for the fallout. Should be hilarious. :driver:
 
Haven't had it happen to me but if it did happen, I'd just send em a bill. You used my photo for your website? You get to pay for it.

Not paying for it? Your bill just went up to include the lawyer fee for the special phone call.

Just like off roading, gotta pay to play.

Everyone already knows rustys sells junk anyway. People are still going to send them money. They may be great in real life, but I personally don't have a single good thing to say about their products or service except cheap. Looks just like something they would do.
 
Dang...I guess I look at it differently than you guys. I took it as flattery when I found my rigs. I find this no different than when someone goes to a car show and takes a pic of a rig (or my rig) then goes back and posts it on a forum. I'd just be flattered someone else appreciated the work I put in to my rigs...and enough so, that they want it to use on their site. If you don't want your rig on their site for whatever reason, and you request it be taken down, and they don't...then there's a problem. If it's misrepresented (as it appears to be in the original post), there's a problem...either have them correct it or take it down. Or if your rig is on a site that you don't want it associated with, then there's a problem. It's a pic on the internet, it's no longer private when it's posted, so either never post pics or copyright your images.


Seems to me, this is another case of people wanting something for nothing
 
Something to be aware of............

Just so you are aware. What you are looking at is something submitted onto Rusty's website by a reader. Similar to other vendors who provide a mechanism to showcase "Reader's Rides" he is not creating that content, that is someone posting it up and making claims as to the ownership/content/parts used. Something very easy to do in today's cut and paste world.

And as some of you pointed out, you can take it as flattery that someone views your Ride as nice enough that they want to call it their own, or be annoyed by them for taking credit for your work.

Just be aware of who is making the claims and who is not.

Do what? If I took the picture, I can do what I want with it. If someone takes that pic for their use without my permission, that is bad stuff. The subject of the picture doesn't matter, it could be your Jeep or it could be a flower. Even if I post it online, that does not give everyone the OK to take the picture and use it for whatever they want, its still my picture, posted online or not.

Now, if someone took that picture and posted it to Rusty's as their own, thats not Rusty's fault...

BTW, I'm not reading all that BS on the other forum...
 
Agreed about Rusty's...however, equate that picture to the very words you post on this site, they're not any different. But the words on this site can be used anywhere, anytime by anyone with an internet connection. So like I said, if you don't want someone using your stuff, either copyright, trademark it or don't post it. Hell...how do you think google images is still around? You can pull anything from there and do as you please. If it was against the law to use those pics, don't you think it would be shut down?
 
the use of the words. text, photos, etc. is what determines if its illegal or not. Copying my words and claiming them as your own is plagarism, copied from online or out of a book. Using a photo without permission of the photographer (or owner) is also not legal. It happens all the time, but bucause its not entirely enforced or even if the owner of phots doen't care, doesn't mean its right...
 
Nowhere did I say claiming it was yours was ok. So in other words you're saying every photo posted on this very site of someone else's rig, someone else's parts, or the photos in the nekkid pic thread in the garage need the expressly written consent of the owners? I don't think so. Agreed if it's copyrighted.


Edit...from what I'm gathering, non-copyrighted photos are fair game (with some issues involving commercial use). Copyrighted images can be used with permission, and they can be used without permission when 'fair use' laws are applicable.
 
You don't copyright something. As soon as something is created, it is protected by copyright laws. You don't have to file any paperwork or anything. You can't have someone arrested for copyright infringement. This falls under civil law. You can sue and have the infringers cease and desist or you can seek damages. A creation is still protected even if you post it on the Internet for the world to see/hear. The only creations that are not protected by copyright is stuff in the public domain and unless it is 70 years past the creators death or created by the government then it is not in the public domain. To use a creation you need to follow fair use guidelines or get specifc permission or general permission in the creation.
Do they not teach this in schools anymore especially with the advent of all this technology?
