Seller took my money then nothing...

Not anyone of this site....

Brought a rust free west coast car body. Seller quoted me and price and shipping. Paid via Paypal in November. He has had this problem and that problem then he said he had issues with the shipping company. So about 5 month later I have nothing to show for my money other than a bunch of BS emails.

Can I do anything OR am I SOL??
 
Sounds like the craigslist scam... Harsh.
 
paypal can only deal with claims within a 45 day window soooo if it was a private sale off craigslist or something idk what you could do.. im sorry man, ive been in your shoes before and it sucks!!!
 
Add was on a fourm specific to the type of car I brought the body to restore.

He had good reviews but yeah the Paypal window has long since past.
 
Track him down and call him. Find out who is the resposible person in his family and call them (parents or maybe kids). Find out where he works and call him at work too.

At this point give up on the body and tell him refund only. He will come up with excuses that he doesn't have all the money. Tell him to pay what he has. Every nickel you get back is a good nickel.
 
SOL the guy has your cash and i bet that email account is gone, Im sure the email account is not in his name. Have you ever talked to him on the phone?? If you have not then you might really be screwed. This has been a big scam that has been all over the news, they email you ask for payment so they can ship the car, and then disappear. They make their money by building up peoples trust and then going for the big sale (scam).

Look into a phone # and contact your police dept.

More details on this would be good,too.It sounds like you are still in touch with the guy.That's a big plus.I know from a past dealing with ebay for a substantial amount of money that if the deal took place over state lines and he tries not to send the item it constitutes Wire Fraud.Talking to a lawyer,or letting him know you are gonna be talking to a lawyer usually helps.Even if it's not a lot of money,my understanding is he would be liable for the lawyer's fees as well as the original amount owed if you can prove through e-mails,paypal receipts,or voicemails that you in fact paid him for an item and he never got it to you.I would say you have a pretty decent case from the little amount of info you have offered although again more info would help with solutions.
 
I know my dealt with a similar situation on ebay. Bought a car from a guy and the car never showed up. She called the police and they told her to contact a specific branch of the FBI that dealt with online fraud. Also told her to contact an attourney about the whole wire fraud thing. Nothing ever came of either one of those contacts other than more lost money to the attourney. Lawyering up only helps if you know the persons real identity that your dealing with.

If your still in contact with the guy, I would try and bs him a little and tell him your coming out his way on a trip and will pick the car up. Get an adress and then google map it and see if there is really a home there. If so send the police to his place and see if that works.
 
Yes we are still in contact and I have a couple different email addresses and his phone number. I have not called him since I feel I have nothing say other than what has been said. I gave him till this Monday to ship or return my money. I have no response. Yesterday I asked that my money be refunded no later than this Friday. So I am going to give him a couple days. Monday I will contact a lawyer and go from there. I am out close to a grand which I think I will fight for.

What started the whole non response was he told me he was having a problem with the shipping company picking up the car. I asked for a picture of the crated body. He said he would get me one that night. Well a week went by and I asked again with no response. I think what happened is he sold me the body but can't follow thru on the shipping for whatever reason. If he quoted the shipping to low I could have sent him more money....like in the first week or so of the transaction. NOW he would not get another dime of my money. I did not get on that forum and call him out as I think keeping this a matter between us is best. I asked for help on this forum as I knew I could get a good response without getting in a flame war with anyone.
There are good folks on this board...never had a problem with anyone selling stuff in NC.

I put the screws to him and he has/is making good on getting my body shipped. I am glad I asked on here. I used the "I have you address and the number to the police station" that got a fast response.

Just so you know if you have an actual email they can trace the IP address. At least a good IT guy can. I had a stalker one time and we traced the IP address to their house, school and work. Needless to say she is now on probation
