The Jeep is in Pieces

Well, I was going to State today, going down Wake Forest Road towards downtown, when a woman pulled out in front of me. I was heading towards the intersection and the light turned yellow. I had enough time to make it through the intersection without running the light. The woman pulls in front of me, I jerk the wheel to the right. I hit her passanger side fender with my drivers side wheel. The ass end of the jeep goes skyward, the jeep does a handstand, pivots and falls back down, skidding across the ground up the sidewalk and hitting the concrete handicap ramp at Denny's. I'm fine, just a bruised heel. The girl was fine, although she was taken to the hospital, just for nerves. The whole undercarriage of jeep was basically sitting on the ground. I could reach inside the transmission with two hands, transfer case was in pieces. If i can salvage it, I will as this was my first Jeep/first vehicle. Pics will come tom when we go look at it. I was charged with failure to reduce speed(i was running the speed limit) and running a red light, although i KNOW i didn't, but the lady "had" a witness that said I did.) Anyway around this? First accident/run in with the police, so its all new to me. What do I need to do to contest it? Get an attorney?

zack as your roommate i feel that it is my responsibility to break this to you before a claims adjuster does. that jeep is not salvageable. if you go and get a new tub, front fenders, grill, frame, tranny, tcase, front axle, possibly new engine, and possibly a rear axle you might be able to rebuild it.

hey i know where there is a place that has all this. me and brett stopped at it today. i think it is called moss salvage or somethin like that but they charge junk yard prices. much more expensive than lkq but they have a lot of things, i mean a lot of things that lkq does not.
 
All you need is a witness that says her light was not green, and then it is her responsibility to yield to oncoming traffic, regardless of what your light was.

well i mean it would be easy to prove that her light wasnt green because even if he did run the read light she never had the green light. the green arrow that comes up for left hand turns at that intersection is at the beginning of the cycle. you could also look at it this way: they hit head on so that would have to mean that she was blocking the intersection, therefore if he had the yellow and would have been able to make it he would have had to slow down to avoid hitting her but not giving him enough time to stop before the light turned red if this is the case. therefore it should be her fault for failure to yield to on coming traffic. this sounds right to me but i could be incorrect. the only thing that could really help this out is to find out where the witness was standing that said he went through the red light. if they were no behind him than it should automatically be thrown out.

actually it should be VERY easy to prove what if it was green..

Just as long as you know the EXACT TIME the accident happened.

Some traffic lights (probably the majority now, theyve been switching over since the early 80's) run on computer based programs, probably monitered from a central base station.

Easy to recall the exact time of the incident and check against her and her witnesses claims.

Now if there is no computer run lights, check and see if the city knows the timing for the lights, if you know the time there you can try and figure out whether the light would have been green yellow or red at the incident time.

Id also check around for traffic cameras, as the accident took place near a college (I suppose? Not familiar with the area around there)
 
Tell the insurance that she could have avoided the accident and they will investigate and initially her insurance will have to cover the cost of her car. My wife almost rear ended someone and swerved right into the grass to miss him and he turned right and hit her rear corner and the insurance company made him pay for his own vehicle. All my wife was responsible is her own car.
 
Well here are some pics of the Jeep. Most likely, all charges agaisnts me will be dropped b/c of the lawyer. The lawyer is gonna see if he can get her charged with either running the light or failure to yield. The Jeep will be parted out. The tires are already spoken for, but everything else will be for sale.

the wheels/rims are taken..Amanda is gonna buy them and put them on her jeep. But everything else is for sale. Engine should still be good although the trans, xfer case is gone..

How much for the springs and CV driveshaft?

Oh, and that sucks about the wreck. I'm glad all are OK. From the looks of that Jeep, it coulda been a lot worse!
 
the springs are gone, at least im pretty sure they are..im gonna look at the DS its a tom woods, ill be taking it apart tom....there will be a FS post in the swap meet section.

are the axles shot? What was under it? You have any accessories for it?

Sorry to shoot so many questions so fast, but its gonna be a field day with this one.

And IIRC theres a guy in Gastonia who just miiiight purchase the whole thing
 
there is a D30 and an 8.8 with drums..don't know if they are bad or good yet. the motor had a new head job and it has the Howell TBI setup, but the motor has a hairline crack between the last two freeze plugs...didn't mess anything up..just leaked a lil coolant from time to time, nothing major...and yes it will be a major field day...Let me get everything started and I will start to post up prices along with pics.

haha, Doubt switching D30's with drums under a TJ is a good idea..

but I'll be checking it out. If onnnnly it was a TJ. I need a center counsel for mine.

Good luck with insurance and such. I heard Nationwide is a bitch to deal with if she has that..

Chances are, your insurance will pay for yours, and hers will pay for yours..

NC being a "contributory negligence state", if either party is 1% at fault, it basically becomes a no-fault deal... I've had dealings more than once about this crap.
 
we only had liability on the jeep, so the insurance won't be giving us anything..she was driving a 4 door nissan car, maybe an elantra? I talked to the insurance lady and she said I can go ahead and start parting it out. If the insurance people took it, I would not be able to get any parts off of it( i.e. tires etc,) Ill get a lot more money if I part it out.
