Ok here is the deal.

I spoke with a Local resterant about getting some of there Waste oil to run in my truck.

They said that if I wanted to put a 55 gal barrel behind there resterant they would put some there waste oil in it for me.

they allready had a service that was picking it up. the resterant said they use about 90 gal a week of oil in there fryers. which is way more than I could ever use. so I have got some oil from them out of my barrel over the past few weeks.

Today I went to check to see how much oil was in my barrell and the barrel was missing. so I found it about 75 feet away hid behind some trash bins and the custom lid I made for it was found inside one of the trash dumpeters.

I look in the comercial WVO bin and it had been emptied.

my name is on the bin and it says waste cooking oil property of my self.

So I called the comercial company and asked them about it and they said that they had a signed contract for the pickup of all WVO and that the oil that was it my barrel was there property and I was stealing it from them



So when does this oil be come there property?

do they have the right to remove it from my barrel?
do they have the right to discard my barrel or parts of it in the trash?

I have moved my barrel to a different location to hope to avoid this, but I think it is going to get ugly.

They may have a leg to stand on depending on what the contract said.. but my understanding is that the oil is the restaurants property until it has been put into that companies container..

So if you can get a copy of the contract from the restaurant owner that would help..

so if that is the way it was written then no they can not touch any oil in your container, or your container. otherwise they are stealing from you just like if you pulled oil from there container.

but in short they have zero right to touch or move your container.. I would put yours back and then go back as much as possible and hope that you can catch them in the ack of touching your container.. then call them and state you have proff they did it and you will see them in court..

otherwise just go TRy to find another restaurant :)
 
Like Ken said it depends on the waste company's contract with the restaurant. If, like they said, they have a contract for all the oil then the restaurant is not supposed to be giving you oil. But even if that is the case, that is between the waste company and the restaurant. That does not give the waste company the right to do anything to your barrel as you have done nothing wrong. But whether or not they have the right, unless you can catch them in the act, your chances of stopping them are slim.

However, as a practical matter, it may just be easier to find a new restaurant to provide your oil.
 
I was in restaurant management for 17 years. Yes I had a contract for waste oil to be picked up. The name of the company I remember was Carolina Waste Products. They come around ever so often, depending of amount of waste, to pick it up. As I recall, and it's been a while, they didn't pump it out, they just switched out barrels. As a side note, for all you paint the face ladies in the crowd, a lot of it was used to make up! Ever notice how easy lipstick glides over your lips!
What I would recommend would be to talk with the restaurant manger. Find out what their schedule is for changing out their fry vats. Most are on a schedule. Come down the day after the vats are changed and collect your oil. Always keep your barrel clean, and area around it clean, and it'll go a long way with their cooperation.

Thanks that is what I am doing. I check several times a week.

What part of their contract allows them to take your property and toss it in the dumpster?

Most restaurants still pay to have the oil removed from what I have been told. Your best bet is to do the oil removal as a co-op with other interested people so that you can offer to take all their WVO for free. You might not be able to use 90 gallons per week, but what about you and three or four friends? Distribute the workload and the costs if you're converting to Biodiesel and then you can all share in the end product.
 
1) *MOST* Waste oil companies are actually paying for waste oil now, and charging a slight monthly rental for the container. Vastly different than 5 years ago.

2) I have heard of prices as high as .50/gallon paid by these companies, and monthly rental rates around $50

3) At that point their beef is with the rest owner as already said.

4) You have broken no law, but you may have led the restaraunt owner to a breach of contract situation

5) If you find a savy restauranteur he can actually find a gov't program that allows him to a tax credit for donated oil for bio fuel production. * Note I am not a tax accountant, nor have I researched this myself. However my neighbor is running a greasal kit and I was looking in to it, we worked a deal with a local owner and that was what he told us he was doing. I never completed mine and my neighbor has about 350 galllons of wvo, so he began selling back to CBP.
 
I recall reading several threads like this on the WVO boards... some folks devised a covered "funnel" that allowed the restaurateurs to pour in the WVO, but didn't allow thieves anywhere to insert a dip tube... without a key to the padlock.

OTOH, if the "other collector" doesn't take your WVO/container, they'll resort to other things like leaving the lid off off the funnel to catch rainwater (if it ever rains again!) or contaminating your stash to make brewing/filtration a PITA.

Either way, may be time look for a new supplier...

If you are a co-op the govt requires alot of paper work and tax paying.

My supplier and I get along really good so if this continues he might just tell them to take a hike
 
I would learn how to spell 'restaurant' and the difference between "there" and "their" :flipoff2:... after that, just chain your barrel to where they cant move it. Somewhere the property owner would be ok with. You and the owner have a key. Make the lid so they cant take it off and lock that as well. Mark it as Toxic Waste and BAM, your in business. Ha ha best of luck!
 
I was walking to a store near work and I pass a small waste oil dumpster and I saw an interesting sticker on the container.... It said some mumbo jumbo about not putting contaminated oil and this long list of junk in their container etc.. My thought was if your supplier had similar rules they could just say it was contaminated, then dump it in your bucket.... Problem solved..

Then you put a sign on your container saying that if anyone touches your container they will be prosecuted to the fullest extent of the law...
