ok so i know we have covered this before, but one of my friends who rides with me likes to booze at night at camp. we have talked about if its ok and such and he emailed to ask about it. this is the responce we got. i dont know if they mention the camping areas off the trails so maybe someone can fill me in. otherwise its good info FYI. :beer:

my question are the baden lake trails the ones we ride?

Dear Pscribbles:

There are certain areas in Uwharrie National Forest that are closed to the possession of an alcohol beverage. These are:

All trails and developed areas in the Badin Lake Recreational Area of the Forest, and also the three wilderness trailheads in the Birkhead Mountain Wilderness.

If you are in the Badin Lake Area, and you are in a campground, boat ramp, rifle range, parking lot, picnic area, or on or adjacent to any trail, you may not possess alcohol beverage.

If you are in any of the three trailheads which enter the Birkhead Mt.
Wilderness, you may not possess alcohol beverage.

At any other places in the Forest, such as Yates Place or Morris Mountain, or dispersed camping, you may possess alcohol beverage provided you are at least 21 years of age and your possession is otherwise lawful.

There are signs up in the Forest explaining this regulation. We do enforce this regulation, and violation of it carries a $50.00 fine. You are welcome to read the regulation in any National Forest District office. The regulation is written pursuant to Title 36, code of Federal Regulations, section 261.58(bb).

Yes they are. All campgrounds, even the ones right off the trails, all the trails we ride, etc. There was a time that they would look the other way in the camp grounds if you kept it in a cup and were civil, no drunken loud partys. That's over. Too much abuse. From what I'm understanding, they are busting a lot of folks, pulling them over and searching coolers. Best bet, leave it at home. Don't take the chance.

I like a beer as much as the next guy, in fact, I like it a lot. But even I'm leaving it at home now. Not worth the risk.
 
I do it and do it well, hell, half the fun of camping is sitting around a fire drinking. They stop allowing hooch ill go elsewhere. I dont booze on the trail nor even carry it with me so I dont care about a cooler search to keep it off the trails.
 
i am curious if this is something that is a national law or if this is a local decision. either way i dont booze there, but i like for my friends who are just riding to be able to. i have noticed they are becoming very strick on unregistered vehicles. if you camp at arrow head and drive to the trail, or similar.

tellico isnt anti booze is it?

Actually, I've been OK in the TN side. The officers stopped by and saw us drinking and didn't say a word. I mean, we wern't hiding it at all. It was obvious we were drinking. The next day we went riding and left a few in the cooler under everything (forgot about them) when we threw the cooler in the back of my Bronco. Rode all day, came back to camp and just before we crossed a bridge to get back to the TN side there was a road block and they were checking all drivers AND all coolers for alcohol. Took all of our beer (16 cans) and gave me a $200 fine. This was on the NC side. They said we could have all we wanted on the TN side, but not the NC side. So, we had to truck back to town on the TN side to get more. I've since decided not to take anymore up there.

That was like 2 years ago, so it may have changed since then.

Most state parks/ohv areas/nat'l forests I've ever been to have been "alcohol free". They just don't enforce it in a lot of places, like they don't enforce a lot of other things. I suppose it just depends.
 
WELL............

Yes its true there is a NO telerance on alcohol in the NATIONAL PARKS. NONE!!! They will bust you HARD and fine you and I have even seen a few people get hauled off to jail and thats a long ride to asheville from tellico. :( The fine $$$ has gone up too. It was $75 per can or bottle as of last year when my friend got fined over $5,000 for all the coolers of booze he had in his truck and camp site. The sad thing is they poured all of it out on the ground and recycled the cans.

My bestfriend and I got confronted about drinking 3 years ago there and we were on the TN side in a free campground. I knew the park ranger so he did not ask too many questions. We were very careful about what we were drinking out of and where we kept it all. There is NO reason that anyone should be drinking and littering out on the trails. Save the drinking for the campfire and telling stories. BE CAREFUL!!!!!!!!!! :smokin:
 
oh yeah. don't drink on the trails. thats a big no no.


we were in the camp site. Never once did we ever have a problem with the alcohol other than when were coming back from wheeling and were in the NC side. They specifically told us we could have it in TN but not NC. The TN officers later that night said the same thing to me as I was taking a drink of the Bud in my hand. This was also a fee camp site on the TN side. Like I said before, this was a couple years ago and the rules may have changed since then.

actually, there is ONE exception to the no alcohol policy. a LEO or FF can have it IF its directly related to the performance of his/her duty. i just havnt figured out what dutys i would have to perform that i need to be drunk for ???

We used to camp in Uwharrie a while back and drink at the campsites without any problems. We allways camped over near Baiden Lake near the horse camp. We had nice bon fires too. That is what camping was all about. We even had part of my Bachelor party there & the Tiki in High Point! :D

Respect the park rules, they are nice enough to provide these trails, so abide by the rules. Really though................ I don't see a problem with it as long as the driver is completely sober and no one in the party is littering or causing a disturbance. Rules are rules though.............. Ride hard, park it and then have a cold one in the designated areas.........

Sometimes...when the tanker runs dry.. ya gotta put SOME kind of wet stuff on the red stuff... :p
 
I do not understand why just having it in your possession is illegal but rules are rules. You can carry a loaded Gun and you are fine but if you have a beer in you cooler you are busted. :confused:
 
That's what I was going to add! If carry any kind of weapon, you better leave the alcohol at home! A friend of mine got busted big time in the Pisgah NF. He was camping with friends and forgot about his handgun in his truck. They searched and found, tagged him for about $200!

I expect that would have to do with stuff they confiscate from others, until they get it back to the station, if it's needed for evidence or some such. I doubt it means they'd be allowed to drink any.

Not by the way, what about "near-beer" like O'Douls or Sharps, with little or no alcohol content?
 
National Parks (Department of Interior). Firearms are a nono! Never had a problem with alcohol in the western parks (camping, not driving) and I've never seen any signs banning alcohol except on Indian reservations.
National Forests (Department of Agriculture). Firearms okay, not concealed. Wear mine on my hip all the time. There are restrictions on where you can shoot (targets etc.), around homes and established campsites. I have carried mine openly around USFS personnel with no problems. Alcohol, not driving of course, never seen any restrictions on USFS or BLM lands. As long as you are not drunk in public (around other campsites, etc.) and don't make an a** of yourself outside of your group, and you are not participating in a volunteer work project, possession has never been a problem. I believe parties of 25 or more require a permit.
These are the rules I have encountered in the western states I have lived so far, I don't know if the eastern forests have regulations in addition to federal laws.
 
I read over NC gun laws thoroghly a few years ago, and to the best of my recollection no firearms are allowed on any government property unless otherwise posted. Parks, libraries, schools, fire stations, courthouses, ect. Anywhere where you have to pay admission ( any sporting event-car show), anywhere that serves alcolhol. I'm pretty sure.........
 
State government laws do not apply to Federal lands with the exception of wildlife management. Firearms have never been allowed in gov't "buildings" even with conceal carry laws except for law enforcement personnel conducting official duties. Firearm possession on Federal lands (with the exception of the Park Service) is pretty lenient if not concealed.
 
conceald or not i havent had a problem at uhwarrie. i got stopped in a traffic stop on the dirt road there on the way into camp. i have my conceal carry lisc and told the officer i had a handgun under my jacket. he said that was fine and thanked me for showing him my ccw and telling him about it. he never said they were not allowed on the property.
