Buying a handgun for someone who has no CC/PP

I was gonna get my PP a while back, but with us getting ready to move and my DL not having my current address on it...I decided to wait. Well I have moved and requested a new DL with my current address but getting a day to go down and actually get my permit is the problem, since I work before and after the offices have closed.
My question is.....my father in law has his CC and has offered to buy a gun for me and I just give him the money....
My question is...if I go into a shop and pick out the gun I want and then he does the transaction.....any problem with that?
Also too...I was going to use my credit card to pay for it, but not sure how that would go down since I cant legally buy a gun.
I plan on getting my conceal carry but I want to be able to practice on my buddy's land and get used to it before I go to get my CC.
 
Yeah, it's a straw purchase, and it's a Federal felony.
 
Yeah, that's a no go! When you purchase from a shop/dealer you have to complete paperwork that specifically asks if you're purchasing for another individual. It can result in felony charges. I'd recommend waiting til you have a purchase permit to avoid any legal issues.
 
Could you go up to VA and buy a pistol since they don't require permits? I've bought guns in va as a Nc resident but never hand guns.
 
Even to gift a handgun, the person you give it to must obtain a pistol purchase permit or have a ccw permit in order to take possession of it.
But, I don't think there is a law concerning borrowing or lending a handgun.

ok thats cool. I should be getting my new DL in the mail next week and then I just found a place close to my work where I could possibly go and get the permit before work...now, my only problem is finding a shop that has the gun I want (SCCY CPX-2) if you are wondering why the SCCY....I have heard nothing but great reviews on it and for less than $300 you get (2) 10 round mags, a nice compact 9mm, 2 pinky extensions, and a lifetime warranty that transfers with the gun.
I have called every gun store I can think of and none of them have it in stock.......grrrrrrrrr
 
legislation to make the purchase of a firearm by a family member intended as a gift legal was recently shot down.
 
Yeah if you were to try the process you described in the first post, theres a good chance the ffl would flag both of you and at the very least no pistol for you and the next NICS check for him might say no go. It might depend on county, but I'm fairly sure NC does pistol permits online now too...unless youre a minor or a felon, why not wait the week.
 
I've been wondering about this as well. I know a guy who was given a pistol as a gift several years ago from his dad. The pistol was originally purchased new in the mid 70's. then given to my buddy in the late 90's. It has never been registered to him. For that matter, I don't know if in the 70's they registered guns to buyers at that time anyway. Are these gun laws old laws or only instituted in recent years? and does the current owner need to go get a permit for it? And do the same laws apply to rifles/Shotguns?

Permits online? you mean print the form and take it to the sherrifs office? or apply for one online? I have the form filled out and ready to go once I get my new Dl in the mail...
 
@mbalbritton: You do not need a permit to own a gun, only to purchase/take possession of one. There is no gun registry in NC. The dealer retains the paperwork at their store when you fill out the 4473 at the time of purchase, if purchased through an ffl.

Lincoln County does online applications for permits now. I filled out the application on a Monday and they were ready to be picked up on Wednesday of the same week.

You pay online at the time you apply.
 
I 'heard a story' about people that bought a certain caliber revolver (with enough power and a large enough bore that it is required to be test shot at the factory so Maryland can have a ballistics sample) for their son's 21st birthday. The story says it's still in the son's possession, and was never transferred to his name. I'm not saying the story is legal or the right thing to do...and I believe in the legal purchase of firearms, but I think the moral of the story is that the world will not implode and you will not be taken away by some government agency, never to be seen or heard from again.
 
You should have moved to Randolph County. Last time i applied for a PP i was in and out in 15 minutes with new permits in hand.
Had my cc in 3 weeks in Randolph!
 
And to answer the question about crossing state lines, you can buy long guns in another state but handguns are limited to the state of residence. If you want a handgun from another state you will have to get it transferred to your state of residence and fill out paperwork there to get it. Also, little known fact(because dealers just wanna sell more guns), if you buy 2 handguns from the same dealer in the same day your name appears on a list which is circulated to federal, state, and local agencies...
 
... just stay out of Meck county... took me 90 days to get a PP and almost 8 months to get my CCW. People I had taken my CCW class with had theirs within a month (different county)

There is no way to "transfer" registration of ownership in NC since it is never actually registered. When someone buys a gun from ffl, they keep the paperwork. If that gun is sold to a private party later, it is up to the buyer/seller to have pp or ccw & do a bill of sale for the transaction. Another option would be to have it "transferred" at a ffl, which is paying them to essentially do the same thing and retain the documentation.

So I called a dozen places yesterday to see if they had the SCCY CPX-2...noone has them in stock....Can any gun store order a specific gun? I checked out the SCCY website and found a local store that is a dealer, but when I called them to ask if they had any, they said no and I asked if they get them in often and he said no, he hasn't had any in for a while...just kinda acted like he didn't want to deal with it as did everyone else I called....

I really wanna find someone whos got one, so I can hold it and get a feel for it.
Any shops you guys reccomend?
Triad Firearms on their website has one it says for $236.50 but got no answer when I called the store 3 times.
 
Unless your dealer is a dick, yes he can order one. Or you can order one off buds guns or somewhere else for a decent price then have it shipped to an ffl--just find one that charges less than $20 for a transfer. They are not very popular though, i would be surprised if you found one at a store.
