Does the CEL light have to be on to have it checked? Seems I heard the computer keeps a history of why it is / has been on?

Not typically. It'll store quite a bit of data from when it was on for a while.

Sometimes it wont pull a code if its not a "hard code" meaning the computer stored it. Other times it can read codes with no CEL.

what is the year/make/model
most vehicles will turn the light off if a certain amount of ignition cycles have occured without detecting the issue.

Its a friends 07 Jeep Patriot. The light keeps coming on and off but the dealer claims the light has to be on to check it.

Dealer is wrong, that model will store any DTC in any module for quite a while. Just like Transman said, "x" number of key cycles or good trips.
