Gun laws

You still have to be careful about guns in a case - if not locked, and on or about your person, they're accessible. Unless you have a CCW permit. Again, never forget the shower thing... ;-)
FWIW, I just finished up my CHP class a month ago and he stressed that the permit is a Concealed Handgun Permit. Not a concealed weapons permit. So I guess a CHP would not guarantee you freedom to conceal any other weapon than a handgun. That is, if he is correct.

Yeah. I get that one confused too. Again, I'm only playing lawyer in the shower (tone of my voice sounds much more authoritative in there). It makes sense as the whole concealed handgun thing has come about in recent (for some of us old farts) years, while many of the other laws have around for much longer.

Like no blood alcohol if carrying concealed but open is fine (one supposes if no other offense). Still dumb, but those little side trips sometimes just happen. "Oh, the guys are going for a beer after work", er damn.

You are going hunting. Your rifle/shotgun is in a soft case either laying on the back seat or in the front passenger seat. You have 2 boxes of shells in the front passenger floorboard. You get pulled over. The officer is a rookie and is on his power trip. Are you willfully violating a concealed weapon law?
 
Open carry of pistols and rifles in NC is legal for anyone that can legally own a gun. That being said, use common sense...most people that publicly show off guns for whatever reasons usually come off looking like giant assholes. That being said, technically it is illegal for anyone in this state to "conceal" in any way a long gun without it being in a locked case/out of reach.
Depends on the city, district etc.
 
Yep, it's concealed handgun permit.
Even stunguns, and tazers, and maybe collapsible batons would be illegal to conceal.

I really wish we had constitutional gun rights in NC .... wanna stuff a shotgun down yer pants .... go right ahead!

Yes, this would be illegal as far as the law--though not as far as common sense. If you had a lock on it in the back seat, could be a different story. It would be no different than you having a pistol in a holster shoved under the seat or a lever action in a scabbard anywhere in the truck.
 
Does NC law say "locked" or "lockable" container?

It was explaind to me that the reason shotgun scabbards have two zippers is so a (small) lock can be ran through both locking the container. SC law say it has to be enclosed in a lockable device.

There is also the issue of concealed vs enclosed. A gun on the seat in a cse that clearly resembles a gun is not concealed and I cant imagine a conviction being upheld on that.

I cannot believe this. If the LONG GUN is not loaded, how can it be considered a " dangerous weapon ? " If no ammo is readily available/accessable any unloaded gun is just another tool. I see no danger what so ever for LEOs and only another infringement of our rights.
 
Sure, but you can also get a dui (and lose your right to buy a handgun) for sleeping in your truck after drinking with the keys in the glovebox.

No. Age and experience of the officer has nothing to do with legality.
In a case .... a long gun would not be concealed. Unloaded or otherwise.
Unless it's in a violin case.
Contrary to popular belief, NC gun laws don't cover ammo.

Brax ... how about quoting the specific part of the law that makes this illegal?

BTW- Officers do not establish guilt. Neither does the state attny. general. That's the courts job.

Was always told that discharging a weapon in Raleigh (maybe was Wake Co.) was illegal, and included paint ball guns, bb guns, etc. Would think the flower shell fell into that category too, right?

I'm pretty sure that only pertains to properties in the County, not inside city/town limits where most municipalities have their own gun and shooting ordinances.

It shall be unlawful for any person to shoot or discharge within the corporate limits of the City, any air rifle, gun or pistol, or any spring gun, pistol, or other similar device which impels with force any shot or pellet of any kind.

So, I guess you get to debate with the LEO who arrives as to whether that empty shell casing had "shot or pellet of any kind" in it before it was emptied... while handing him/her your shotgun...

I think " any kind " includes any kind of seeds, it does appear you can shoot all the blanks you want to legally

I don't get what you're asking? Yes. It depends on your county Sheriff as to who does or does not get a handgun and concealed permit. Burke county is fairly lenient and the penalty for dui is no pistol permits for five years after conviction. CHP's are going to be at least for five years--if not forever.
