So I sold a kid my truck who lives in Raleigh, I thought I trusted him, so I let him write me a check. Well it bounced and now I have no truck or cash, but I do still have the title in my name here.
I told him to deliver the truck but he wants me to come get it. Well I have no money and no way to get it.
Can I just call the police for a stolen vehicle?
How would you take care of this? I just need some input.
 
I would tell him to return it or you would let the law handle it.
PS: let him know that in North Carolina if you intentionally write a bad check you can be sued for trebble damages!
 
Report is stolen/bought with fraudulent funds. Also charge a fee for returned check and recovery. Take that sh!t to trial man!!
 
I have, and he seems to think he is god and they will do nothing.
 
Start posting up his name and address.
Also the Police should help you out. That is theft. I will be in Raleigh tomorrow and can ride by and check on the truck. Not stop but possibly look if its close to where I will be.

Report it stolen and let them "not do anything." it should be easy to find him since you have a check with his name and an address that they can look at.....
 
This is pretty cut and dry.
until he provides cash, he stole the truck.
There is no question about that. Quite simply, call the police and ask them how you should go about it.
I would have called and given him 48 hrs to produce either cash or truck back at my front door - but if he threatened back, no need to even be that nice.
If you have a check, then I assume you have both his name and address.

Well after him hearing about going to jail and getting his credit screwed over.. he's returning the truck on Wednesday. :lol:
Maybe it finally sank through :shaking:
 
Take out a title loan or check advance or whatever you need to do and go get your truck ASAP. You know he's dishonest. The longer you wait the worse condition it will be in. If he is willing to let you get it, go!
 
When you said it bounced what did the bank stamp on the check? NSF or closed account? If its a closed account then he wrote the check with intent to fraud. If it was just non sufficent funds then that is alittle harder to prove in criminal court.
If you dont get you truck back then send him a certified letter requesting payment in a certain amount of time. If he does not respond or fails to sign for the letter, then you take all the paperwork with you to the magistrate and you can swear out a warrant.

Just make sure you have a friend or four over when he comes by. He probably ain't gonna beat your ass, but who knows. He might want to try. Mainly, though, the intimidation factor will make it easier to keep him on the property while you check the truck over and do what you gotta do. If it's just you, he may just drop it and run.

And be sure to remind hi mto leave $40 in it to cover the NSF charges you got hit with at the bank PLUs the loss in time/use of the vehicle.

You have the upper hand now, use it.
Hell politely call and talk wit hyour local police station - explain teh situation, and ask if they wouldn't mind havin gsomebody drop by to be there around the time he shows up. Just to be there, not do anything...
 
I had a similar problem happen. I sold my truck to a kid. I was only asking 1800 for it and he paid me a a deposit of $800 and was going to make payments. I agreed and after he paid me a $100 dollars a week for a month, he asked if he could take the truck. So me beeing a nice guy said yes. Well the lil fucker moved to Fl a month later and still hasn't paid me in over 3 months. The police can't do shit, because I have to take him to small claims court etc.. So I have a title and he has the truck. So I reported it stolen etc.. And the tags run out in April. So on my spring back I'm going take a bike trip to Fl.
 
Just got the truck back. Everything seems to be there and in working order.
I was hoping they fixed the miss in the engine.......but..... :(
