How do I get blood from a stone? (get a judgement paid without breaking kneecaps)

I'm still over here trying to figure out why folks would pay upfront money to someone they have no track record on. Besides, why would the concrete man need upfront money to start with? The biggest bills he's going to have are labor and the concrete, and both of those are due after the job for him

hell most of our concrete guys i have to pay for the concrete and they provide the labor and equipment only
 
Is the judgment against him or his company? There should be a way to go back to the magistrate and file paperwork to have his account "seized" by the sheriff and have the money forcefully taken?

I have heard of such a thing before, but pretty sure it was in another state.


Judgement is against him personally since he wrote the contract from him and not a company. I think that works in my favor as he can't hide behind an LLC or other company protections. I believe there is a way to file paperwork, but here's the rub. I'm already out the initial $1500, $7.38 for the certified letter that he dodged, plus the filing fees for the small claims court which were $126. He has also dodged the sheriff deputy twice when attempting to serve him the criminal misdemeanor summons. From what I'm reading, serving him with additional papers will cost at least another $30, perhaps more - only for him to dodge that too. I'm not griping about the money, it's more the principle that in this whole process, the courts don't seem to be looking out for the victim at all. It's just a money racket. (I guess I AM griping about the money!)

I may head to the courthouse and see what they say.

The way I do things in my shop is to settle up 100% after I'm done. No $$$ down, or anything. When I'm done and you're happy with the work, I get paid.
Keeps everyone honest.
If it's a build over a certain $$$ amount, I'll have them settle up with an invoice from my supplier.

I didn't know how they operated billing wise, so it didn't seem too off-base to need half up front. Also, during that point in the summer, we had contacted 5 concrete companies and he was the only one to even show up for the appointment, so we felt like we were kinda stuck. Come to find out, we had been given a wrong number on the referral for Father & Sons Concrete who we eventually gave the business to and they did the job right, only wanted pay afterwards and were done very quickly, cleanly and politely to our neighbors.

That's how my guy is too. When he gives me a quote it's just for his costs. I pay the concrete bill.

Sometimes he gives me a quote and I think it's a little high. Then I remember that the last concrete I poured and finished has bull float lines and holds water like a swimming pool. Then I'm ok with his quote.

That has been my experience also. You pay the delivery driver when the concrete shows up. No $$, no concrete or work.

Local roofer who has been around a long time does it similarly. They do a take off and send you 2 quotes. One is the labor and one is the materials through Builder's First Source. You pay the materials directly to BFS. Then you get on the roofer's schedule after signing a contract with lien info. Settle up with them upon completion. Easy process and everyone is protected.
 
If he is a racer at Bowman Gray and like most of the racers Ive known, I suspect that he is in his shop most evenings and weekends. He will also be at the track on Saturdays when the season starts up. Find his race shop, or at the track. Even knowing both of those, I dont put high stock in the SD serving him.

Bingo. Sheriff most likely will try to serve him during first shift Monday through Friday. As the gal from the Sheriff said on the phone, "even if we know he's home, we can't bust down the door." So basically, the Sherriff department has no more authority in getting a hold of him than the UPS guy leaving a note on the door, and will try even less so.

My BIL was trying to get his Ex served with papers, to get his kid back.... knew where they lived, she didnt have a job, was avoiding the SD. He ended up waiting outside her new BFs job, and following him home, while calling 911, to get the cops to basically pull them all over, and serve the papers. Not saying I would suggest doing this. But I wonder if there is a GPS tracker that could be easily placed on that box truck, if you happened to see it out.
 
I'd consider joining the Northern Davidson County Facebook page and splattering his name all over it constantly. I dropped the page because all of the drama, but it might be a good resource.

All have similar stories to mine, and all have the same peoplem with the law not being able to track him down.

now, message all the people and setup a plan to show up to the first race of the season and go and confront him in the pits. your probably not going to get your money back, but they guy might get a good shake down or better yet the police arrest him if everyone else filed all the correct paperwork as you, ( again message them and make sure they do the same as you) pretty soon the police and other people will get tired of the shit storm yall make for him and he gets whats coming to him

Bring all that to a lawyer and the cumulative charges and pattern of behavior should make a better case.

So I spoke with another one of his victims today and found out a lot more. My deposit is small potatoes compared to some of the others, but the main reason he has gotten away with this as long as he has and with as many victims is that he is spreading out the scams across several counties. Forsyth, Davidson and Yadkin counties are all represented, and most of those DA's do not work together to build a stronger fraud case, they just treat them all as mini-frauds or misdemeanor larceny by conversion (or whatever it's called).

Another big thing is that the man is LITERALLY worthless. Not only is he a scammer, thief and liar, he owns NO property. He is 45 and lives with his parents, so the house is not in his name. They tried to put a lien on his truck, but he got wind of it and "sold " it. His race car hauler is in his dad's name, as is his son's vehicle. The only potential asset is his race car, but it's sketchy at best to try to attach to it legally since it is most likely home built. (think some of our non-titled trailer queen rock crawlers for example)

I have come to the conclusion that I will never see a penny of the money owed me, so I plan to put him on blast in every social media venue I can find. His name is Casey Kepley, Jr and lives at 1796 Friedberg Church Rd Winston Salem, NC 27127

He supposedly does some hauling for uship.com under the name Kepley Enterprises.

Not that I think it would do much good, seeing some of the totals he's screwed other people out of.

You should be able to include all of the paperwork fees in the next step. Like being awarded court cost by a judge.
