I just dealt with an exhaust issue of that type on a Tj I bought. It had a leak in the pipe between the muffler and where it exited. Because the small leak was under the vehicle, no pass until patched. Only a PITA if the place you took it to can't weld. I was smart enough to ask before we started and the guy at the 1st shop was solid enough to let me know A. it wouldn't pass and B. he couldn't patch it.

So after $100 and a stern come to Jesus for putting me in the system as failed (he lied and said he didn't) I discovered that this Midas got hit with a $220 ticket for letting a Farm Truck pass without the exhaust extending out the rear. So the guy built me a really nice and tight section I can remove that is bolted in and even built me a turn down that I can clamp back into place once the large extension is removed. Faith in humanity somewhat restored.
