I can't remember if this was discussed on here before but I have a question about misdemeanors and applications for employment. I have a hunting violation on my record. I always wondered if it would show up on a background check (it does show) and if so did my application get canned before I could even explain what happened. Do employers ever do checks before they interview or is that usually something that is done after the have decided on a candidate but before they actually hire the person? Is it something that I should be concerned with?

Depends on the profile of the job being applied for.

Most will only look for Felonies, embezzlement, ect. Most anything over 20 years old won't show up. Your typical employer only has access to certain databases anyway.

I bought my license at Walmart and asked and paid for a state Duck Stamp (permit to hunt ducks, it is actually a stamp) and the clerk did not put the stamp in the license envelope. I never checked and didn't find out until the warden checked me. Fortunately I did have my federal stamp which at the time was purchased seperately at the post office.

Normally, they only care about felonies.. My record isn't spotless either.

Besides, a hunting violation is hardly a big deal in most people's mind.

I disclosed my misdemeanor (possession of alcohol in a state park)with my current employer, and it did not come back to haunt me. Also I disclosed it when I had to get security clearance to contract with the FBI.

Personally I wouldnt hesitate to disclose that information to an employer, it would give you a chance to explain what the charge is, the circumstances, and prevent termination of your employment due to non-discloser.

^^^^

DISCLOSE IT ON AN APPLICATION.
It would be easy to explain away, and a potential fly in the ointment years down the road if it was disclosed you lied on your app...

You can hire a lawyer to get it expunged.

Expunging doesn't guarantee that it actually goes away. I've pulled records with expunged charges before. Basically, it stated that the charge was xxxx and it was expunged. So all that does is say that yes, you had a charge, yes you were guilty and yes you had it expunged, which amounts to nothing.

The same thing with juvenile records, pulled them too, even though many parents said I couldn't pull their kids records, amazing what a police records check can do;)
