Apparently I have a judgement against me from the Hospital due to a motorcycle wreck from '99. Knew nothing about it.
Any body know any good lawyers (or any body on here one) that deal with judgements around the High Point, Greensboro, Winston area?
I believe the judgement can be vacated on numerous possibilities. Main one being breaking the Federal law i.e. Emergency Medical Treatment and Active Labor Act.
Throw me some good lawyers names. First hand experience with them preferred.
All help appreciated.

Just paying what you owe would make it disappear. Why try to get out of it if you owe it.
No it wouldn't. A judgement against you stays on your credit for years. I went through the same process with a hospital many years ago and just paid it and the judgement interfered with us buying our house even though it was satisfied.

I had the same thing. Got out of it cause at the time I was unemployed so technically I was "indigent". You can see about receiving some kinda charity to help compensate if you are not financially able to rectify it.

Best of luck

I understand what you're saying but he want's it vacated. Basically he wants his emergency care for free which in turn causes everyones health care to go up. If he'd pay his judgement the judgement would go away but not the credit hit. If he's asking for a lawyer to make the credit thing to go away that's cool but I don't think that's what he's wanting.
It's hard to believe someone has a judgement against them and they don't know it. I guess it's possible but like I said hard to believe. Do you not get a summons to court in order for someone to get a judgement against you?

I did, but I don't remember how I was served. Whether it was a Sheriff or registered letter that was sent to me. Byran McElderry didn't bring it to me or anything.

I use Joel Oakley for about anything. He is a damn good lawyer, short guy with a cane, used to be a wrestling coach. Never let me down.

Well let's see. I was a part time student at the time at GTCC. Was unaware my dads insurance doesn't cover part time students (even thou two months early they paid a $150 ER bill, but when a $12,000 bill rolls in they deny it and that's just the ER part not all the other bills they send ya???). I asked if I could get some of the bill discounted but the hospital said I made to much money ($13,000 a year at the time, well below the amount they use to give "charity discounts" or on the rolling scale). I'd paid off all other bills from accident except ER bill (didn't have $13,000 laying around). Was making payments on it until I was laid off so I could only pay the essentials and the ER bill doesn't keep me alive. Finally got my job back after two years and the National Labor Relations Boards help. By that time they already slapped a judgement on me. I contacted hospital to work out some way to pay it off and their para-legal called me back after I'd gone up there 4 times over two weeks to try and talk to some one. He said I'd have to pay the whole amount plus the interest that's accrued Anne could not do any thing else. Now total is $20,000. So I got to looking and I never should of had to pay the bill in the first place since I didn't have insurance and I didn't earn enough money at the time.

+ some of this:
1995 YJ, 350, SM465/D300, D44/14bff (D60F in progress) , 39.5 Boggers, etc...
1995 YJ Juggy project. On hold.
1995 YJ "Kraken" project.
1993 Toyota Xtra cab, V6, 5.71's, 39.5 Boggers, 10-11" total lift, etc... (thrown rod in engine)
2000 Lincoln Navigator, 24's, rear ended bad, etc... Daily driver
1999 Suzuki Hayabusa spiffy'd up
=
Closer to paying that bill.

Not that I care if you pay it or not, but you've got 6 vehicles listed in your sig, several of the projects. It seems like you've had expendable income at some point in time between then and now.

Hah, was just about to say something about that. Sell your "all spiffy'd up Hayabusa and your incredibly impractical Navigator, and you might be closer to your 20k that you owe.

Seriously dude...get your priorities straight :shaking:

Some things should just be left off the board.....if you know what I mean

My priorities were straight before I had a motorcycle accident back in 1999. Accident caused me to have to drop out of college so I could work full time to pay the hospital bills. I didnt try to get out of not paying I did the opposite. I quite school so I would be able to pay stupid ER bills that blown out of proportion any way. I should have gotten some sort of discount they sure do give them to the insurance companies. You ever look at your insurance see what they "allow", whole lot less than what the doctors charge. But since I had no insurance and apparently by what I was told back then made to much to qualify for discounts (poverty line was $16k back then, I made $13k. Hospital goes by poverty level) my life got ruined for years because I got discharged from my job and couldn't make payments any more. Then when I do get my job back and try to work out some thing with hospital I'm told "I can do nothing more to help you", after I paid them about $4k before I was discharged. Now they want $20k. Makes perfect sense to me.
P.S. I got Busa, Navigator, Toyota and '95 Jeep way before I was discharged from work in '04. I tried selling some of them but not taking less than what they were worth.
Kraken cost a lot less than you probably think to build also.
Don't pass judgement if don't know all the facts. What is this the new Pirate forum.
I asked if any body knew of good lawyers that handle judgements. Let's just leave it at that.

If the original bill was $13k and the rest is interest, usually with arbitration they will knock off the interest and go back to the original bill.

... I never should of had to pay the bill in the first place since I didn't have insurance and I didn't earn enough money at the time.

and I'm sorry you had some shit luck, good job for doing what you had to to try and work your way out of it... but the above statement is a big part of why our health insurance system is in such bad shape.
Why should you not have to pay? You incur the cost, it's your debt. You think the doctors just owe you free care?

I had no problem having to pay it. Yeah, it is my debt. No, I don't think they owe me free care, but.
They don't want to arbitrate didley and charge me almost three times what I "owe" of over inflated charges to be begin with. The procedures I had under the CPT Medicare coding would total $2000. That's why now I feel like screw it if there's a loop hole I'm using it because I don't have $20k on hand and they don't wanna work with me on it.
I also feel like "medical debt" is a whole lot different than say a car loan, home loan, debt consolidation, etc. You know what your getting into with other types of loans and the consequences if not paid back. You don't say "hey I'm gonna go get in an accident and rack up a shit load of bills" that's why its called an accident. That's what EMTALA is for.

I was trying to stay out of this but it keeps getting better. Your first sentence is not true. You didn't have any insurance and you chose to ride a motorcycle therefore your priorities were not in the right place. I'm assuming a dirt bike.
I make sure my insurance is paid before my power bill. I can live w/o lights but no insurance can ruin a man's life forever.
I'm not looking to make you mad w/ the things I've said hope your not but these things are true all these guys are stating. It is hard to hear but the best thing you could do is sell all your toys and then some and if you can't come up w/ the 13k I'm betting the collection agency would probably settle for less if you wave cash in their face.
Only other thing to do if your hell bent on not paying your debt is to file bankruptcy. I know a guy in your same situation that had a streetbike accident made around 10k a year and couldn't pay his bills but his house is paid for so the hospital was coming after it. Some people don't think a hospital can take your dwelling but boy are they are wrong. He had to file bankruptcy just to keep his house.

Nah, I'm not mad at any body (except para-legal that doesn't want to work with me).
It was actually a street bike. It had insurance on it they didn't pay my medical costs, paid the bike off thou. I'd thought I was covered under my dads insurance at the time. So when the adjuster (for bikes insurance) brought paper work I signed it. Then found out my dads insurance doesn't cover part time students so then tried to use my bikes insurance to pay bills. But the adjuster did his job real good and had me sign those papers real quik, signed my rights away. Older now and know better.
I'll work out something. Thanks for replys.

Insurance almost NEVER works for part time students. In general you have to be in school for at least 12 credit hours every semester until you graduate or your insurance from your parents is dropped.

yes, judgements can be renewed every 10 yrs. dont know any attorneys to help get 1 off. but I know 1 im working with at this time to place 1.
as far as medical bills, and ins. I now have over 40k cash in my right ankle. its funny how ins. co. can get out of paying bills but we cant
