Ok Gonna try adn summerize whats going on so every one will know then ask a few questions.


Traded my xj for a f100, title was noterized wrong, dmv wouldnt take it said to redo it, guy lives in ashville and will not respond to any calls/txts/emails and just so happens to be out of town everytime I ride up there. also found out the title was an open title, he never had it in his name so he forged the signiture.

Now to get my tickets for the tag bs droped(going to court friday adn gettin it continued) I ahve to file an idemnity bond on the truck and have a theft inspector come look at it.

So. . .

Has anyone done this before?

Lets say the truck was stolen
1.) does that go against me or him for sellin me the stolen truck?
2.) if they take the truck from me can I get my xj back for the guy? or am I out a jeep and a truck??
3.) ppl sue ppl for all kinda crap today, anything I can sue for haha?

Maybe you can sue him for all the time your going to lose in court and at the dmv office.:lol::shaking:
Man that sucks...I have no idea what to do but the DMV is like dealing with the IRS, good luck bud.
 
DMV title BS can be a pita.
If you can find out who the original owner is, they can file for a lost title and help you with the paper work. I'd offer up some $ right away for their assistance (upon successfully transferring it into your name).


Bottom line. Signatures need to match how its printed on the front.
Bob A Jones = signed = Bob A Jones
Robert Albert Jones III = Robert Albert Jones III

I have started asking about titles even before driving to look at something, and asking to see it even before deciding to buy it.

As a seller, it the title is in my name, I don't sign it until I have a buyer ready. There are so many notary places around, most pack/ship stored can do it. Its just easier to have both sign it at the same time..

I've had open titles where I've had to try 4-5 pens to find the same one to help minimize any potential BS.

I had to do the endemnity bond thing on a sami I bought years ago. Turned out not to be much trouble. Worked out well for me in the end.....until it was totalled by an uninsured mexican.
 
How does the indemnity bond work? What if you do that and then want to sell it? How much does it cost?

its amazing the crap you have to go through to do the right thing and be legal. I know why ppl break the law with stuff like this. Its cheaper and easier :shaking:
 
I have a similar problem with a car trailer, my buddy did the money transaction for me (I live 4 hours away) and had the seller sign the title over, then my buddy's wife was supposed to notarize it when I signed it. But now she feels like she shouldn't because she wasn't there when the original owner signed, so WTF do I do now??!

unfortunately, you have the stolen truck, not him. he will deny ever having seen that truck. good luck. you need it.

In all seriousness, have yousigned it yet? the right thing to do would be to mail teh title back to him,and have himgo find a notary who he knows, and getit notarized.Heshouldbe able to showID and probably sign something, to show the already-done sig matches, and they stamp. Then he mails the title back.

Or, you buy your buddy's wife a few margarita's and work out an "understanding".

That sucks,I was t-boned by an uninsured schizophrenic In Chapel Hill 8 years ago.Totaled my car and Ruined my back.Learned a valuable lesson though,uninsured motorists insurance is like $2 a month for most policy's

In most cases here the notary can feel confident if you have a copy of the Seller's driver's license faxed over and she can compare the signature on the drivers license to the one on the Title.
 
just got back from court, got it continued . . .

waitin on the inspector to call and set up a time to have the vin verification done. . .
