So the wife was just in an accident, the woman infront of her for some unknown reason (she apparently barely spoke English), rolled backwards into my wife's Jeep. My wife had to get out of the Jeep and tell the woman to put her parking brake on.

The cop seems to have written it as a no-fault situation, judging from the wife, he didn't want to deal with it, "he got in his car, said good luck, rolled up his window and left".

He told her, in this situation, typically both parties insurance pays for the other vehicle....ours is a 97 XJ, hers is a 2013 Hyundai, I am not inclined to pay for repairs for her vehicle that she claimed...

Any advice? Claim it, will insurance go up? I don't want to fix my jeep on my dime, just to then have to pay insurance premium mark-ups for this.

I told the wife to call the cops, so this woman couldn't claim later that we were at fault, I guess that didn't work out.....I guess a dash cam is in our future.

Based on the accidents my wife and I have been in...without cameras/witness it becomes he said/she, and/or the person who hit the other person's ass end is the one at fault. Right now, I see this going as the other lady saying your wife didn't stop in time and hit her...your wife is going to say the other lady rolled back in to her...and you'll have a deductible to pay. And I assume that's what was said and why the cop said what he did.

Drop your insurance. Then you can just use uninsured motorist coverage and the rest of us will pay for it.

No witnesses, it was tagged as "non-reportable" by the police officer. My wife said the woman sat there in her car and did not leave after the police left. I suspect she had some sort of mechanical failure that the police officer was not willing or able to verify.

this is the reason I am seriously thinking of putting a dash cam in all my vehicles or one that can swap between my many vehicles.

If it was city/county , i would have called shp or vice versa and said look this lady rolled into me. Officer came and left, neither of us were able to understand the lady. She hasn't moved the vehicle can we get a different officer to do a wellness check and further investigate.

My dash cam died but I am definitely getting another one.

A no fault means your insurance will pay for your vehicle and theirs won't pay for theirs because they probably don't have insurance.

NC is a no fault state. Meaning the cops don’t determine fault. The ins co determines culpability and liabilities. It will be between them who pays what percentage of the damages.

Thats debatable. In this case sure but a cop can definitely determine fault in many cases. I want to say NC is not specifically defined as either fault or no fault state for LEA's. I know this because when I got Tboned in my wife's car The Cop was able to use witnesses and CCTV from a gas station to determine the other driver at fault. I requested both a copy of the accident report and their ticket.

Just an FYI, if you download Magic Earth (on iPhone anyway) you get a built in dash cam with recording times you can set/adjust. Plus it has crash settings you can set. It also has driver assist (like lane departure and such) if you turn it on and speed warning with adjustable over speed limit settings. Traffic cams, popo alerts and such too.

It is a really good free and open source navigation app in its own right and I used it as an app on my android based radio in my super duty. It was way more accurate and less rabbit trails than Tom Tom or Garmin.

It has real time traffic like Waze without the Google if you use your phone as your navi. I just downloaded it to my iPhone because the Tom Tom in my Jeep has pissed me off for the last time 😖
