Need Advice - Getting Screwed by Shafers

First off, I do not want to create another "bash a bad seller" post. Please only reply if you have advice on what legal rights I have and what I can legally do to get my money back.

I ordered some axle shafts in May of this year. Some time later I found out they were back ordered and that they would be built soon. Here is a timeline of events, all conducted through e-mail that I have copies of:

On October 6th I checked again to get the status of the parts via e-mail and got a reply that their internet was down and they can check on them. (How does that make sense?)

On October 9th I checked again on the status and got a reply back that they would be finished that week.

On October 21st I checked again on the status. I got a reply that they would check, but never heard back.

On November 7th I informed them that the delay time is unacceptable and that I want a full refund. I got a reply back that they apologize and wanted to know if a substitution would suffice. I thanked them for the reply but informed them that I just want my money back ASAP and I would go a different route.

On November 25th, after no refund or parts or even a reply to my previous e-mail I send Shafers another e-mail asking them to advise a date that I can expect to see a refund posted to my account.

Today, December 8th, I still don't have a refund, parts, or even a reply so I e-mailed them that they have till Tuesday December 11th to post a refund to my account or I would contact my credit card to report fraud.

What can I do to get my money back? What legal recourse do I have? Who can I contact beyond the fraud department of my credit card? The BBB?

Please help. This has been dragging on for 7 months now.

reverse your credit card charges. this will automaticcally go into dispute and you will get your money back ASAP. the only way for them to keep your money is to show proof of delivery, which of course never happened.

no worries, you got em by the balls. I would make the call immediately to the CC company.

call the cc today, explain and its done.

BTW for anyone else, if you use a "VISA" debit card and are asked debit or credit? ALWAYS say credit. It does the EXACT same thing at your bank but is covered by VISA fraud protection (for cases such as this) where as debit cards are not.
 
The word(s) in cases like this, if they went to court, is "documentation, documentation, documentation". Whoever has the most documentation wins. Past time to be doing email, at this point everything should be old-fashioned written communications, preferably registered.
 
I would contact Don Griffin at WSOC-TV. He gets results when consumers get screwed. You'll end up with your money and the satisfaction of knowing they got bad publicity on the news.
 
Thanks for the advice guys. Yeah it's superior axles, both inners and outers for a D30.

I will never do business with Shafers again that's for sure. They have done nothing but brush me off and lie to me from the get go.

I have no problem with back orders but this is :poop:
 
CC disputes are usually supposed to be within 60 days of the purchase.
Probably you can still get them to do something if you still have all these emails and provide it to your CC company.
I'd definitely try it.
 
Not that I agree with shaffer's lack of communication and bad CS, but it seems that everyone is having this problem with superior actually shipping their shafts anywhere close to when they were supposed to be shipped. Though, stock d30 shafts shouldn't be too hard to get...
 
i've been waiting on superior shafts also with a different vendor for a month or two. word was last week that my shafts should be shipping and be here sometime late last week or early this coming week.

I am not surprised. I had a similar experience with Shaffer's over a Superior ring and pinion set. That was about 2.5 yrs ago. After all the threads I have read on ppb about Superior, I will not buy another one of their products unless the sales person I am talking to assures me they have the part on the shelf ready to ship.
 
Still nothing from Shaffers. My credit card is contacting them to dispute the charge. They said if Shaffers could not produce proof that the product was shipped (which they can't) the CC company would reimburse my money.

It's a shame that I had to forceably get my money back. :shaking:
 
Get your $$$ back and order some Alloy USA shafts.. I ordered mine on Monday... at the doorstep on Friday for $495.00 shipped....

Who did you get yours through? Mine took over a month from roundeyes. It's funny how offroad vendors seem to and can get away with stuff that noone else could or would...
 
I've heard of vendors having to deal with backorders on AlloyUSA shafts as well. The two people that I know of just got theirs after about two months of waiting. I guess they're finally catching up with the demand.
 
I can handle two months no problem. I've been waiting 7 months on Superior / Shaffers which I haven't heard anyone doing. I know of other people that have ordered later than me and got them after a month or two.

I question whether Shaffers ever even placed the order. Either way they won't be getting my business again.

I think I will go with Alloy USA when and if I get my money back and use a vendor from the Carolinas if at all possible.

I ordered mine through DC @ www.DC4wd.com But that was 3 weeks ago... but like I said called monday and at the door friday...

I think it also depends on the vendor and how much business they do w/ a certain company.. maybe they get perks or dibs or whatever?
