PO left item at our new house, any ideas?

Responsibility is clear - it is upon the real property owner. It is up to the real property owner to take necessary measures to prevent injury to guests and trespassers. If you do not intend to quickly handle this, it would behoove you to fence it off, or otherwise protect it from the public and potential theft. You have contracted yourself into the position as caretaker for someone else's property in which you failed to specify the contractual relationship and liabilities in the execution thereof.

Would you presume to understand the intricacies of a surgeon and his tool choices, and presume to define the proper arrangement for a successful surgery? Many can understand the details of a new car they are about to buy, but often understand very little of the contract they are about to sign.

You never know who you are talking to... Go find your "far more educated people" on Main Street. Dont expect help from others with that attitude.

A little FYI, as you obviously have never studied law. The spirit of the law in this case is often in regard to landlords and property of previous tenants. The abstract principles of which apply in this case. Different sections of a statute often are written in regard to one common subject matter, and often the use of "other" is used as a broad stroke of the brush to apply to everything. Wherein case law would dictate the applicability.

The worse thing you can do here is operate from "i think". Make the calls. Give the legal notices. Contact your Main Street attorney to do it for you if you lack the knowledge or fortitude. With very little effort, there is no reason why abandoned property on your land should still be there 30 days from this date.


Woah there buddy, didn't mean to blow your dress up. Obviously you are correct, I never have studied law, never had the interest. I wasn't pointing that about far more educated people then me at you, I was saying I will talk to the closing attorney, and take your alls advice, which so far is "far more educated than me". Also, I didn't wana send a letter saying "but the guys on nc4x4 said" lol. Just saying in times like these I'll get an attorney to do the dirty work, and take your alls advice. No attitude meant.

Anywho, I have tried to contact him a few times, usually no answer by phone, and a short answer through text.

Good point about whose responsibility it is, never crossed my mind to be honest.
 
Also, about your comment on if I lack the courage and knowledge, you must have had a long day. Of course I can write a letter, make the calls etc. May need you to spell some words for me, but I could probably do it. I've seen a few times though when stuff doesn't hold up because of the wording not being correct for legal reasons, that's where an attorney would come in if it comes to it when I give him til the end of the month.

Call him and tell him,I sold it,its gone,it got stolen,whatever.I guarantee that will get him to come by and check things out. All jokin aside,I would do what McCracken and Ron said. Call dude and tell him to come get it,if he doesn't call him back and tell him he has X amount of days to get before you charge storage.If he still don't move it have your affairs in order to take possession of it.My aunt went thru this after her husband died,he had got about 25 years of free storage on some old trucks and equip,long story short she wound up signing over the titles AND paying a portion of the storage bill.
 
I have no idea what it would cost to fix it and get it running, but can you place a value on having the land cleared that you want to attain for cattle? Does that cost benefit you if you got it running and cleared your land....

This. Talk to him, explain that he needs to move it, and ask if you getting it running will help speed him up. But of course, you get to use it first if you get it running. If he doesn't seem responsive, you need to get a lawyer to send a letter.

Thank you sir, I should have worded it differently, after reading it a few times I can see how it could have been taken the wrong way

You know I've thought about this before many times. Only way I can see it back firing on me is I spend, let's a grand in parts and/or labor, somethin comes up and I can't use it the next day, then a truck rolls in to get it. I have considered telling him since we've been considerate with him taking his time, to let me borrow it a couple weeks after he fixes it. I'll keep everyone posted thanks fellers

DONT put a red cent in to HIS equipment until its legally yours.

Well what if you fix it then he gets its and something major happens, thrown Rod etc, then he say your illegal fix destroyed his machine.
