Thank you for contacting my office regarding H.R. 437, the Assault Weapons Ban of 2013. I appreciate having the benefit of your thoughts.
On January 29, 2013, Representative Carolyn McCarthy (D-NY) introduced H.R. 437 to ban the sale, transfer, importation and possession of "assault weapons." This bill seeks to ban firearms based on their manufacturing specifications and other features. Weapons affected by this proposed ban would be any semiautomatic rifle that can accept a detachable magazine and has any one of the following characteristics: a pistol grip; a forward grip; a folding, telescoping, or detachable stock; a grenade or rocket launcher; a barrel shroud; or a threaded barrel. H.R. 437 also seeks to ban pistols and shotguns with the same characteristics. Besides banning firearms, this legislation also bans the sale or manufacture of magazines that hold more than 10 rounds. H.R. 437 bans by name 159 different firearms that are currently legal to own.
H.R. 437 has been referred to the House Judiciary Committee, where it awaits further action. While I do not sit on this committee, please know that I will keep your thoughts in mind should this legislation come to the House floor for a vote.
With regard to the Second Amendment, I believe that the government's responsibility is not to limit the lawful rights of honest and law-abiding gun owners. Rather, it is the government's duty to strictly enforce current gun laws and to levy stiff penalties against criminals who use guns to commit crimes. As a National Rifle Association (NRA) member, I am working tirelessly to protect the Second Amendment rights our forefathers fought to provide. While serving in Congress, I've supported several pieces of legislation to strengthen the protection of Americans' Second Amendment rights.
In the eyes of the Founding Fathers and as reflected in the ordering of the Constitution, "the right to bear arms" was nearly as fundamental in importance as "the freedom of speech." Yet, as with "the freedom of speech," the right to bear arms comes with a huge responsibility. Irresponsible use of either of these rights can be destructive and detrimental to society as a whole. However, the actions of a minority of people abusing their freedoms should not limit the freedoms of the majority of decent and upright Americans.
I am honored to serve as your United States Congressman and I will continue to fight proudly for the people and the values of the 10th District of North Carolina. If my office can ever be of any assistance, please don't hesitate to call.
