Dear Mr. Bowe:

Thank you for contacting my office regarding H.R. 437, the Assault Weapons Ban of 2013. I appreciate having the benefit of your thoughts.

On January 29, 2013, Representative Carolyn McCarthy (D-NY) introduced H.R. 437 to ban the sale, transfer, importation and possession of "assault weapons." This bill seeks to ban firearms based on their manufacturing specifications and other features. Weapons affected by this proposed ban would be any semiautomatic rifle that can accept a detachable magazine and has any one of the following characteristics: a pistol grip; a forward grip; a folding, telescoping, or detachable stock; a grenade or rocket launcher; a barrel shroud; or a threaded barrel. H.R. 437 also seeks to ban pistols and shotguns with the same characteristics. Besides banning firearms, this legislation also bans the sale or manufacture of magazines that hold more than 10 rounds. H.R. 437 bans by name 159 different firearms that are currently legal to own.

H.R. 437 has been referred to the House Judiciary Committee, where it awaits further action. While I do not sit on this committee, please know that I will keep your thoughts in mind should this legislation come to the House floor for a vote.

With regard to the Second Amendment, I believe that the government's responsibility is not to limit the lawful rights of honest and law-abiding gun owners. Rather, it is the government's duty to strictly enforce current gun laws and to levy stiff penalties against criminals who use guns to commit crimes. As a National Rifle Association (NRA) member, I am working tirelessly to protect the Second Amendment rights our forefathers fought to provide. While serving in Congress, I've supported several pieces of legislation to strengthen the protection of Americans' Second Amendment rights.

In the eyes of the Founding Fathers and as reflected in the ordering of the Constitution, "the right to bear arms" was nearly as fundamental in importance as "the freedom of speech." Yet, as with "the freedom of speech," the right to bear arms comes with a huge responsibility. Irresponsible use of either of these rights can be destructive and detrimental to society as a whole. However, the actions of a minority of people abusing their freedoms should not limit the freedoms of the majority of decent and upright Americans.

I am honored to serve as your United States Congressman and I will continue to fight proudly for the people and the values of the 10th District of North Carolina. If my office can ever be of any assistance, please don't hesitate to call.

Tweaked my letter a bit:

As an active voter, NRA Life member, and deeply concerned citizen who believes strongly in the U.S. Constitution and the principles contained therein, I am writing to express my views on gun control legislation currently being discussed in every level of government. I am one of over 100 million law-abiding American citizens who responsibly owns firearms for target shooting, hunting, personal and home defense, and collecting. We need to all be very diligent about protecting the intentions of the Second Amendment, as it is the fundamental concept upon which our country stands alone in terms of ensuring the freedom of the American people, and I am closely monitoring legislation that would restrict my right to keep and bear arms.

I am saddened by the tragic events in Newtown, Connecticut, but I believe that efforts to impose new restrictions on me, a lawful and responsible gun owner, are misguided and unwarranted. The so-called "Assault Weapons Ban," which for a decade restricted the sale of semiautomatic rifles and limited magazine capacity to ten rounds, did not reduce crime, according to a report by the U.S. Department of Justice. And since the expiration of the ban in 2004, violent crime has declined.

Your focus should be on real solutions to the problem of misuse of firearms, such as strengthening mental health care and improving the quality of data supporting the National Instant Criminal Background Check System (NICS).

Do NOT pass more gun or magazine laws; instead, work to reduce meaningless and ineffective guns laws that have no effect on crime, mental illness and other factors and help step up prosecution of criminals who commit violent crimes.

Further, allow law-abiding citizens to protect themselves, their families, neighbors and others by not creating zones in which criminals or the mentally ill know they are "safe" from the immediate consequences of their actions. Allow us to legally carry weapons wherever and whenever possible to ensure the horrible actions of a few are minimized as quickly as possible.

Thank you for your time, and I rest assured that in your role as elected officials and public servants that you will seek to accomplish these goals.

Not to create a debate or anything, but does anyone else see anything wrong with this statement? ban pistols with pistol grips?

i believe the qualifications for assault pistol is more than 7 rounds.
