Speeding Ticket Info Needed ASAP!

Nope, not me! I joined the official "old fart poke around club" years ago!

Co-workers 19 y/o daughter (goes to school in FLA, resides, in FLA, DL in FLA) was going back to school last week after spring break. Gets a ticket going thru Davidson County for... gulp... 96mph in a 70mph zone :driver: . Got a ticket that only says [paraphrase] "have your arse before the Magistrate on this date/time".

Her mom (my co-worker) wants to know:
1) Possible outs (lawyer, PFJ, improper equip, etc.)
2) Are all states DMV "linked" (I know SC & NC are!)
3) Possible outcomes (can NC demand surrender of her FLA DL?)

Personally, I was a bit shocked they didn't take haul her to jail (26mph over!), much less let her drive away...

What say you keepers of the ticket knowledge? :beer:
 
Get a lawyer.... He can go to court for her and she does not have to come back up here.. theres a guy here in town that for 300 bucks it dissappers almost no matter what the ticket is, if u can find someone in your neck of the woods like that, shes golden.
 
Getting a lawyer for a speeding ticket is foolish IMO.

Have her contact the Davidson County DA. In fact, if shes attractive enough, have her go see the DA in person. She should ask him politely if she can be allowed to take the defensive driving class.

This is a 50 dollar class. You go for 4 hours. Generally is pretty much BS. You sit around and do very little.

The class will drop your ticket to Improper Equipment, which doesnt register on your insurance, and puts no points on your license. Now she cannot just apply for the class and go though, the limit is 15 over..

And that 26mph over is NOTHING man. I had a friend who was going down the mountain (from Boone I think) at 120+ mph...he got ticketed for like 120 in a 45 :flipoff2:

When for 300 bucks they can make it go away.. and that includes court costs?? It seems foolish not to. Plus the trip back from florida for a visit with the DA the a trip back for the class seems foolish to me.
 
i just did a defensive driving course last wed. to help me get through my most recent. 21 is the age cut off for the course. I will find out tomorrow if it was worth my time and $50, but i think it will allow me to gain no points, as it's supposed to.

Keep this in mind. With the Improper Equipment charge, there is a fine, I think it is $30. That's not much. However you will probably have to pay court costs as well ( I KNOW you do if you go to court and get a ticket switched to Improper Equipment). Cort fees are like $120.

So now you have $120+$50+30. That's $200.
Plus you have to give up your time and effort to do the class. For some people, this is no big deal - however if you have a JOB, then you will have to miss work or make whatever arrangements.

If for $300 you can get it done with a phone call (lawyer), then you have to consider if the time and PITA is worth $100. For somebody that lives in FL - I seriously doubt it.

Last ticket we got, we have letters from lawyers claiming as low as $260 I think to take care of it - all they do is have it switched to IE also. At the time we (meaning my wife, her ticket, but guess who does the legwork!) chose to get a speedo calibration and go to court as mentioned above. She lost $50 pay for missing a day. We saved $10. Will not do that again.
 
Possibly I should have mentioned that this *ISN'T* her first ticket (sounded like it may have been her 5th-6th! :shaking: )...
While she's under the 21 cap, I'm pretty sure she's used up her PFJ & driving school cards long ago.
So, Macdiddy, tell us what YOU'D stand to loose by not getting a lawyer. :gay:
 
Get the lawyer and fight it. Spend the money so she does not ave to travel back up here. I have a lawyer at court for me today at 0900 (a few hours ago) I will let you know what happens. Save the hassle and get the Lawyer. Not sure if she will get the letters or not but I got like 25-30 letters from different lawyers wanting to plead my case.
 
Sounds like mommy needs to quit bailing the kid out. Let her drive back and forth from Fla la la a couple of times to deal with courts and lawyers and driving schools and paperwork and blah, blah, blah...Might get the kid to think about her speed. My guess is mommy has taken care of the other tickets and not held the kid responsible for her actions...Time for a little tough love.
 
She will get a bunch of postcards from lawyers within a week advertising their rates, etc. Pick one and let em handle it...

Step 2: trade her car for 1960s era VW Beetle which will cut out tickets over 60ish mph anyway! :) Well maybe downhill with wind at her back...

My brother got TWO tickets in the same week, might even have been SAME OFFICER both times, court date was the same day...$300ish and a lawyer later and one was rescheduled to later date, and "got off" both of em with whatever they call it.

Not to say the above was good thing, but he HAS slowed down (afaik), no more tickets since, etc.

My brother was taking Drivers Ed, instructor was going on about driving on defense, Stephen raises his hand. "I was thinking that since everyone else is playing defense, maybe I/someone should play OFFENSE?" Instructor didn't think it was so funny...heh.
 
i havehad three, my lawyer told me that the defensive driving class has to be offered int he district that the ticket was issued, and usually fro one person you can get up to three chances 1) faulty equipment, 2) reduction, 3) prayer for judgement
 
Ah, Davidson county - I believe I got my last ticket there...in my parents' Chrysler minivan!

As mentioned, she will start getting a ton of ads in the mail from lawyers...but the fact that she has a rough history, and this is so severe, even with a lawyer she'll probably get it dropped to 84 in a 70, and have to pay fines, fees, and a boatload of insurance increases...
Going to the beach for high school graduation, I got popped for 82 in a 55...and that's pretty much what ended up happening to me.
 
I can tell you for certain that an NC ticket will link back to Florida... I used to carry a FL license when I was here in the Army.

Hire a lawyer, she'll keep her license. It's a damn game.. the lawyer won't actually fight anything, he just negotiates points and fines.

As for the demands - NC can request that FL pull the license, but it's up to Florida to actually pull it or not. I don't think 26 over is as big a deal in FL.

A side note - N.H. would have told NC to go pound sand, and won't even acknowledge the ticket last time I checked.. "Live free or Die" for sure!
 
Another vote for a lawyer. In my younger days when I wasn't so smart and good looking I got nailed for 7 tickets in 3 days. Opps. Payed them off, didn't worry about a lawyer. 364 days later I was in court with a lawyer fighting to keep my license. Of course those 7 put me at 17 in less than two years. I think all the money I made at my job went to gas or tickets. Funny thing is that those 7 tickets had been my last ones. It just took the 364 days to figure it out. I have gotten some since, but now I drive a slow truck or a jeep so speeding isn't a problem anymore. Still have that problem with stop signs though.
 
Well, I guess with over 30 tickets, I'm a veteran in the motor vehicle court system...buying a Jeep has probably saved me loads in speeding tickets :D
She's not looking at 61 in a 55 zone, that is when you can talk to the DA. With her high speed, she'd be foolish not to get a lawyer. The only caveat may be if NCDMV doesn't talk to FLA. In this day/age its hard not to believe that all 50 states arent networked, but anything could happen with the DMV. I've had local/yokel counties refuse a check or money order and require cash...those tickets don't appear anywhere. In Dillon, SC (Myrtle Beach speedtrap), they assured me if I pled guilty, NCDMV and my insurance would never hear about it; they were tru to their word.
NC can't touch her out-of-state license. All they can do is revoke her privilege to drive in our state (I'm 49 state legal :driver:).
If she has to take the class, take their word and be sure you're on time. I've seen them lock the door at the start of class (and return after break) and turn away all the late comers. I've been to the 4 hr class and the 8 hr class. I don't know what comes next...maybe I'll be a guest speaker ;)

The defensive driving class is also at night, and I saw people well over 21 in mine.

But now that youve thrown in the fact that she has 5 or 6 tickets, getting a lawyer makes sense. Ive only had one ticket.
 
Cutting off the parental teet is the best idea yet.

Have you had to renew you're insurance yet? I got a rude awakening my first renewal after I got 3 in the past 6 month period.
I've had so many tix, my wife's insurance dropped her when we got married :smokin:

Since she's out of state, NC probaly won't look at her record. They'll just throw the book at her and take her money.

If I remember right (grew up in Davidson Co.) Jerry Grimes was the lawyer that everyone used to get out of tickets when I was in High School.

I'm with Galen on this one, Mommy needs to cut her off and make her deal with it on her own. I'd also start making her fork out for the Insurance after the second one. Is mommy concerned about teh Tickets, or is she even concerned about her daughter running 95mph?

As for state to state taking lic. Dave you know mine. 95 in a 70 in Georgia. 9 months later I get a letter from the NCDMV saying to surrrender my lic. Georgia isn't taking it, the NCDMV is. I requested a hearing with the DMV, and I must;ve got a guy that hadn't been laid in 10 years or something. He wouldn't even give me driving privledges to and from work. I called the Lawyer, he got a piece of paper, took it to a DA and a Judge and They over ruled the DMV and gave me the rights to "maintain my household" by any driving needed.

I do know NC/SC/GA have a reciprical agreement to pass info back and forth. FL not so sure about. it was just stated that those three did, and not any others.
 
2nd the Jerry Grimes choice.....saved my ass big time (not just w/ speeding tickets)....
 
Some people here have hit on the real answer. If it was my daughter, and I was footing the bill for this stupidity she'd be walking from now on. Riding a few trips from here to Florida on Greyhound will give her time to reflect on her driving style.

X2 I wouldn't bail her out. like my daddy told me, " you got yourself into it get yourself out."

96 mph is way too fast unless you're on a race track or drag strip.
I'm driving out there too. I'd hate it if she killed my wife or me...
 
I guess I am a little tougher than most parents, and I sure this won't be a popular suggestion.
Let her deal with it. Fighting her battles won't teach her anything. If she has already gotten so many, tickets have not taught her not one thing. Sell her car, buy a bus ticket to school, new pair of shoes(walking) and maybe a moped.
