Sprint Dilemma..........

OK, So I have had no problems with my EVO with sprint. However, my GF has the samsung intercept and has had nothing but problems a couple of months after purchasing it. Her phone would cut in and out and the screen would act up and be non responsive. She would contact sprint and they would tell her to turn her phone off and they would wave some magic wand and everything would be ok. Well a couple days would go by and it would start acting up again. Well today it bit the dust. The phone was going dead, so she plugged it up to charge...it then proceeded to go into safe mode, she then turned the phone off and turned it back on, the screen would flash for a second and cut off, she figured the battery was completely dead, plugged it back up and the buttons were flashing and would randomly call my phone...I was sitting there watching this dead phone make a call to my phone...no screen no buttons....nothing. Took it to one sprint store and he said there was nothing visibly wrong with it, took it to another sprint store and said that the phone has all kinds of rust on the inside of it, and that it had water damage....well, if it did have water damage, would the indicator show this as well?? So when we got home, we took apart the phone to check to see what he was talking about....no rust AT ALL!!!!
Also, when we got the phone back from the tech, the phone was not properly put back together and the screen was distorted and stained looking....this just doesn't seem right and there are already notes on our account that it does have water damage and that is all anyone is gonna see...

What do you guys think should be done? I feel like I should not have to put out $100 and then get a REFURBISHED phone when I bought a brand new one.
