I am trying to buy a 4runner and the guy said the only problem was when you wind out 1st or stay in 1st too long it pops out of gear. Is this a horrible problem? how much would it be to rebuild? how much to buy a used one?

It may just be low on fluid, top it off and see what happens. More than likely it has high milage and is wearing out. Personaly, I'd run it till it dies, might still have a lot of life left in it. A used tranny usualy runs about 2-$250. Probaly one for sale on this board right now.
 
It could also be the shifter bushing. Pull out the shifter and see if there is a rubber bushing in there. If it's just pieces of rubber, you need a new one. Check out marlin crawler for a upgrade.
