Unfortunate event today at skool!

I am a senior in high school, so im sitting in 2nd period today when my principal comes in and asked my teacher if he could speak to me really quick. My teacher of course says yes.
I go outside and there is a county sheriff standing there.
My principal says " The sherif's department is here with the drug dog and the dog stoped at your car"
So we continue to walk out to my truck. Once we get out there was 2 county sheriifs and one city police officer. So the K-9 sherif comes up and asked me why is dog would stop at my truck, being respectful of course I say "no sir i honestly don't know why he would stop at my truck."
he says "would you mind if we searched it," so i gave him the keys.
So while I am standing there while they rip through my car one of the sheriffs is trying to talk to me and like get me to stop watching them go throught my car.
After about 20 minutes they walk back up to me and hand me my keys, and start to walk away. I was like so am i good to go and they said that they found a bottle of advil and a lighter under/inbetween my back seat.
So they let me go back to class.
I just thought this whole situation was funny cause I/nor do any of my friends smoke or use any type of drugs.
Just a big misunderstanding I guess.
But it was funny cause the whole time I knew there was nothing in my truck and they just kept looking.
Funny story thought i would share. . .

When you are positive you are clean, it is much more fun to refuse the search and make them go to more trouble.
 
Well, when you are parked on school property you have already given up your right to consent or not. Pretty sure it is all in the fine print when you buy a parking permit for the school.

The only thing that gets me is when you say "Sure" and they proceed to tear through everything and leave all your stuff in shambles. At least put it back. It's like saying yes means tear all my stuff apart and leave it. I'm more inclined to say no now just beacuse of that.

True, but I'm pretty confident that it doesn't require you to assist in the search, and by assist I mean unlock the car door. They can search it all they want from the exterior of the vehicle.

that reminds me of a time I got my vehicle searched in high school. I had a bottle of vodka locked in the glove box, cop tore apart my vehicle, I was sure I was screwed. He asked if I had the key to the glove box so he could open it. I lied and said no, he asked again saying he didnt believe me. I was 99% sure I was busted, but he carried on and finally let me go I was shocked, but very happy.

So you have to consent to having your civil rights violated in order to obtain permission to park your car on school property? That's bull crap.

IMHO, the fact that you were put in this situation makes the case for decriminalizing possession. What if you had given a friend a ride home a couple of weeks ago, and he had stashed something under the seat, unbeknownst to you? It would be your ass.

The universal answer to "can we search your ..." is no. Once they have a warrant or probable cause, they don't need your permission anymore.

Then they don't need his permission. What I was taught is that LEOs are trained to ask because people generally consent and that eliminates any thorny issues of warrants, probable cause, etc, in the court case.

Nothing interesting would ever happen on COPS if not for:

"Can we search your vehicle?"
"No."
"Why not? What are you hiding from me? I can get a warrant, but it's going to take a while, and waste a lot of time. If you let me look around, it'll just take a minute, and you can be on your way."
"Oh, okay, then."

They're your civil rights. Might as well make use of them.

It was always my understanding that there had to be probable cause (IE- something fishy). So if a drug dog sits at your car that's the sign they need. Meaning there's probably a doobie in the ash tray.

Maybe we're saying the same thing :confused:
 
They don't need probable cause to ask your permission to search the vehicle.

They do need your permission if they don't have probable cause.
 
Yes I'm 18. And yea in the permit papers it says that the sro's can check your car pretty much when ever they want.
And yea it probably would be a better story if i had something in my truck, too bad i didn't. lol

I'm pretty sure none of my friends would do that but thats a good point.
Cause I'm sure the cops here "that's not mine":confused: 100 times a day
