UTVs at Uwharrie questions

Anyone know the rules for wearing helmets on a UTV at URE? My buddy has a Kawasaki Mule and is headed down Saturday and wanted besure on the rules. He says he is legal to ride on the road since its considered a farm machine according to him. So would he be allowed on the forest roads? Thanks for the
advice.

LOL...

The law is pretty clear about using farm tagged or farm equipment. Basically You MUST be traveling BETWEEN land/property that you own, lease etc. for the purpose of farming or transporting property.

As far as helmet... dono... If it has a seat belt, he might be ok... I'd still wear one on one of those...
 
Buy purchasing a day pass for uwharrie, are you not leasing access to the land? Therefore by traveling on the forest roads from one trail or another your transporting property (a can of coke maybe) from one leased part to another?

I'd say this is a stretch beyond reality.

By that logic, you should also be able to drive one around in a movie theater between the box office and the theatre seats... b/c you bought a ticket.

Buying the pass dosn't give you any extra kind of ownership, just the right to be there.
 
Movie ticket is for sitting in a seat and watching a movie.
A Uwharrie Day pass is for driving an Offroad Vehicle in the park.
You don't need a day pass to walk around or sit in the park, I fail to see the relation :driver:

Purchasing a day pass at Uwharrie is a contract, because by purchasing the pass, you agree to the terms, rules and regulations set fourth by forest service. Specified time: 1 day Specified payment: 5.00

A trail Pass gives you a right to be on the trails. A pass is not required to drive in the park as long as you use the forest roads with a licensed vehicle.
 
I see the point, I just believe the argument is flawed due to the pass being stated for the use of the trails and not any other part of the "leased" land. But your argument could be that the travel between the trails is considered travel between "leased" land, so I kinda see what your getting at.
 
still missed it! lol.... Basis was that the UTV could be considered a farm vehicle, the law is stating that farm vehicles can be on public roads if they are going between leased or owned lands. The forest service trails could be considered leased, and the public service roads could be considered public roads that you must use to access your leased land with your farm vehicle.

To be considered a farm vehicle doesn't the vehicle have to be registered as a farm vehicle. Also state rules would not apply to the roads inside URE. Isn't it a national forest which falls under federal law? I would think that it would be considered an ATV. By that logic you could use an atv as a farm vehicle as well?
