Technically, that is called a non-contact participant here in NC. "IF" they directly cause the accident, but are not hit, then they are still involved. However, if they stop short which causes a chain reaction with the next five cars but they are not touched, then it becomes the following distance of the other cars that is "responsible" for the wreck.
