Want to sell a rifle, need a little legal advice

I've got a Mini-14 that I want to sell, and as far as I know, it's legal to sell to a non-felon in NC with just a bill of sale. Anyone in the business got any pointers as to how I can do this and avoid handcuffs?

As far as I know you don't need any paperwork to transfer a firearm face to face in any state. If you were to sell to a someone who was not allowed to own firearms, whether it be an ex-con or someone convicted of criminal domestic violence, I'd guess that there are some federal charges that you could be charged with. Remember CYA (Cover Your Arse). I'd make sure to sell it through a store like 2offroad suggested just to be on the safe side. If you plan on advertising online and shipping it, I would make sure to send it from on Federal Firearms Licensee to another FFL. Most likely gun shop to gun shop, but there are many citizens who have their own FFL. Bad gun sales can come back and bite you if you don't take the proper steps.
 
According to the gun guru in my office (BIG GUN GURU), You do not need anything. SO LONG AS IT'S NOT FULLY AUTO! and if it is, you'd best have the proper lic. to own that. OH and do not ship over state line! Just make sure you get the buyers Name and address for your records, and keep the serial number.

But like said, I'd still check with the local Law enforcement. After all you're asking about the Law in an internet Jeep forum. ;)
 
Talk to the guy for a bit and be sure he is half-level and on the up and up. Use that sixth sense. If it doesn't sound/feel right, you can legally stop the transaction at any point. An FFL is required to stop at tx at any point, for example if he gets any hint or idea it's a straw purchase.

I have worked around firearms for a long time. Every state is different and you need to follow it to the letter of the law. If they are from out of state or have an out of state DL or ID then you need to do it with the use of an FFL we charge $35 per transfer and if the law still stands and I think it does you can send to any out of state FFL and then they do the transfer or the other option it to go local ffl to out of state ffl. The laws change week to week so keep on top of them.
The best way to do it,I feel is: you and him are both in and from NC is get a copy of the yellow form( now white form) and make the person fill it out then put the DL and gun info on it you need then keep it. Make sure you put on the top of the form that using the form for person to person sale none ffl or just copy the parts you need and make your own form. You don't want anyone to think that you ar or work for an FFL dealer. That form will ask the questions you need to ask and have the info needed to clear your name if anything would come up. If they don't want to give the info needed then there is something wrong, even if they say the law states you don't need any of this junk and so on, If you get a bad feeling walk away. Your Ruger will only bring 350-600 at most and being in lock up a few days or weeks will cost a lot more. I know the law may say nothing needed but if you take the time now it will save you time later if something goes wrong.
FYI if you sell to someone you don't know have other people with you and do it in a public place. People are talking of the people coming to look at it in there house and then a break in follows or the look grab and run.
Be safe and get as much info as you need. If you want to put it in the shop and have us sell it or any other shop do it we can it will cost 10%-20% but you never need to worry about it.

Yes and no if a long gun then nothing is needed but info to track the sale like name DOB and NCDL # , FOr handguns you need a permit in one of two forms CC or PP.

You can not ship to anyone but a FFL, That can be the maker, seller FFL, gunsmith with FFL and so on. But no person to person shipping to transfer a gun.

You can sell that face to face. Use your good judgement on this one.

Selling to sombebody out of state
You can sell out of state and ship (UPS or Fedex). You have to ship it to an FFL, and the buyer has to receive it from that FFL. Always check that you are in fact shipping to a real FFL. You can check at the ATF's website.

Usually you can ship in state to a buyer without an FFL involved, but most people don't feel comfortable doing this (Check your state laws regarding this).

You have a mix of state and federal laws to deal with.
