What are the laws on trailers

I have a little trailer that is a home made deal it maybe is 42" wide and 60" long very small. Well my brother in law is a local cop and told me that I dont need a tag because it is so small and he dont have on on his either. Well today I was on my way home not even half a mile from home and get pulled by a highway patrol and get a ticket for no tags on the trailer then he wants to give me crap about I need a bill on sale for the tires that I had on the trailer what bs. Then to top it off I was in Davidson county in Thomasville and he puts on the ticket that I was in Randolph county in Trinity so the Court was set in Asheboro in Randolph county now I have to miss a day of work and drive an hour to go to court in a county I was not in and pay $146 in fines and court cost more then the trailer cost anyway. Is there anything I can do to beat this?
 
You need a tag on the trailer. Your Bro-in-law fucked you.. :lol:
 
Old Thomasville Rd bounces back & forth between Randolph & Davidson counties......that sucks, I've always been under the impression you need a tag on all trailers used on state roads.

Sucks on the ticket though......the "bill of sale" on the tires is the cop being a dick unless you told him you just bought them. You shouldn't have to carry a bill of sale on every item of personal property you carry around.

He pulled me right at my house but o well he ask me were I got the tires like I just took them off a truck up the road or something
 
SC does not require tags on trailers. What do you do if you drive into a state that requires a tag and your home state does not?
 
If you can prove he was wrong on the location it will be dismissed on a technacality. (sp)

Tell him you borrowed the trailer from SC..

technially, wouldn't matter... if you're using it in NC, must conform to NC road laws.

Just like you cn get a ticket for truck lift height while passing through VA even though it's fine in NC.

ive used that excuse a few times. it was a lil hard convincing the cop that a four wheeler with a climbing stand strapped to it qualified as "agricultural use" but he let me off with a warning.
 
I talked to my brother in law and he said as long as the trailer is under 6ft you dont have to have tags will get more info on that tomorrow
 
The only trailers that do not need tags, are farm empliments, like bailers or combines etc. Every other trailer needs one, our fire dept has a 3 footer that holds highway cones, and it has a tag on it

It needs to have a tag.

As for the farm use. It's yours? Do you own a farm, at your house and do your taxes show farming? What was on the trailer and what do you haul on it? That is what you will need to show the court.... Can you,,,,

What I would do Is go get tags as fast as you can, then call the DA ask if you can FAX them the info and a letter that you had ask a LEO about tags and were told you did not need them for what you were using it for "around the house and farm":rolleyes: and see if they will drop it over the phone....

That's your best approach.
And of course be polite.
IF the DA refuses, then you can go about proving you were in the other county, picture of the site, and then a map showing the county lines.
Getting it thrown out on a technicality will annoy people. BUT you still need to get the tags.
As for the borrowing from SC, that might have passed had you told the officer that. BUT you better have something in writing to show that if you want to try that theory with an officer. And since your car doesn't have SC tags it might be a hard sell.
 
All trailers used to haul property have to be tagged in NC. Trailer size doesnt matter. Stump grinders on wheels, cement mixer and items like that do not.

Yep, that's it. There's actually a section on the DMV website somewhere that talks about this. Their example is a pig cooker -- if the cooker is empty, no tag is necessary. If there's a pig or a propane tank on the trailer, now it's a property-carrying vehicle and has to be tagged.
