What do to about a bounced check?

Did some work for a hotel in Blowing Rock a few weeks ago. Long story short, owner wasn't paying the loans on it, and it foreclosed. I cashed the check (it was from the hotel, not a personal check from the owner) and it bounced (although I JUST found this out, Ive been out of the country for 3 weeks).

So what do I do about this? I called the owner about it just now and he is making out a personal check, and asked me to hold it till Wednesday, but he has already given me one bounced, so I dont hold much faith that this new one will work out either.

Just in case, what steps do I need to take to make sure I get my money out of this?
 
Have him give you a bank check (in his name). They won't cut that unless he actually has funds from what ever account he draws it from.
 
can I have the bank check is account to make sure the funds are in it before I put it in the bank?

Honestly, the guy is a good person, just ran into some trouble. From what I can guess, the bank froze the hotel account when it foreclosed, and I didn't cash my check till way after the hotel shut down.
 
There's not much you can do. You are lucky he is willing to talk to you or try to make it good. Take his check to his bank and try to cash it. Have him write the check directly to you personally.
 
hope he didnt file for bankruptcy.

expect pennys on the dollar if he did.

And, hit him up for the $20+ fee you're going to be hit with from your bank for bouncing a check.
 
yeah set up a time to meet him at HIS bank on wednesday to get a bank check, made out to you personally.
 
I got a check once that I suspected was gonna bounce. I went to the guys bank, asked teller if check was covered, she said not enough in account. Check was around $2000, and I kept going back to the bank every couple of days to see if cash was in bank...he was only keeping a hundred dollars or so in that account. Finally after about 3 weeks, went in, asked, he'd just made a cash deposit, and she cashed out the check for me (iirc, traded it out for a cashiers check).

He called me later that week all pissed off, he'd deposited that cash for his house and car payment that were gonna be drafted that night, and they bounced. :) Served him right.

We had a company that owed us 3k. they finally sent a check for 2500 dollars and we cashed it, then spent it were it needed to go. 2 weeks later we get a letter saying the company who gave us the check went bankrupt and we needed to send any payment they sent in the past 2 months (or something like that) back to cover the cost of the bankrupcy. We came close to going to court but at the end we took the money out of our account and gave it back because everything ended up legit.. no matter how "out there" it sounded. so if it works the same way.. you will be screwed.

You will usually not get ANY info from a bank that you yourself do not bank at about another persons account. We have people that come in and want to know if the check is good or not and we legally can't tell them that..we just have to either cash or say " Im' sorry but we can't cash this check at this time" It is hard for me as a bank employee to call another bank and get funds approved....

Always and I do mean ALWAYS get a cashier's check or bank check....they are certified funds and will never get questioned, unless something seems odd with the check (counterfeit)
 
Is it too late to put a lein against the property? Whenever the property sells, the lein has to be paid off before the title/deed will be clear.

Good for you. Don't write checks if you know they're going to bounce.

yup same thing happened to our company on a larger scale. we were doing business with a wholesaler out of warsaw for several months about 10yrs ago when they went bankrupt out of the blue. they owed us around 5grand for product that had already been picked up so we knew that was already gone, tough luck, it happens. a month or so later we got a letter in the mail from their attorney saying we owed them something to the order of 15g. my grandad opened the letter, laughed and threw it in the trash. they sent the bill to a debt collection agency in chicago that kept sending letters that my grandad proceeded to throw away. apparently when a company files bankruptcy YOU owe them the money that THEY paid you for all they goods they purchased from you within the past 2 or 3 months prior to them filing. eventually the debt was sent to the sheriffs dept and they took out a warrant for my grandads arrest :lol: he dodged them for weeks until they were able to obtain a court order to draft the money from our companies bank account. my dad finds all this out after it happens and talks to our attorney and learns that if my grandad had called him, we could have negotiated the amount and paid several G less. its fukked up that the laws are written like this but i guess thats the cost of doing business in the good ol' US of A which hates small businesses. :shaking: the way its set up, everyone gets their money taken back and the money is re-alloted so that the people who are owed the most get some of their money back and everyone else gets screwed.

Assuming that the work was performed in NC, you have 120 days to file the lien. You can and should do this yourself instead of paying a lawyer. Very cheap and easy to do yourself. File the lien and continue to chase the payment, the new life of a contractor...ask me how I know

update on this, he gave me a personal check last week.

I waited till Wednesday to cash it like he asked, and as of right now it still has not appeared to have bounced, so I think its safe to say all worked out.
