What should coworker do when she's accused and threatened?

Now that I've gotten your attention, :lol:
We go to lunch today, coworker drives. (it was her, my jeep or a bike, soo defaulted to her)
We get to there, and some guy is like staring at her jeep in the parking lot. I'm a fat guy and hungry, so I go to get my food, we all go inside. She comes back out first and notices this guy is now under her jeep taking pictures, etc.
She does the usual response? "what are you doing?"
he immediately starts yelling that she hit him 3 weeks ago, and that it was a felony for running. He's calling the cops and she's going to jail for a long time cause it's a felony, etc etc. The whole time he's yelling at her, he never takes off his helmet, so she just starts walking away, partly to get one of us, and he jumps on his bike and speeds off.

After this she's obviously scared, but he told her where it was, and she's never been over there. (Plus you tend to remember hitting someone) I suggested she call the police, let them know he was threatening her, and get it on record that he was threatening her for if he does try to file a report against her.

I have a feeling, the guy got hit by a similar car, and was accusing her, hoping she'd admit, and offer to pay for the flat tire he claimed to get. No matter what it was, he could have and should have handled it differently.

Any different/better ideas on what she should do going forward?
 
So what is the threat? Accusations do nothing except piss you off, but if there is no substance, and no charges, there's really nothing to it.

Yea, the threat was his yelling at the top of his lungs, "You're going to jail for a long time cause that's a f___ing felony"
And more intimidation, etc.
She's a tiny chick, he wasn't small, not as big as my fat ass but still. And he never took his helmet off, etc.

If someone larger than me was shouting, behind a facemask, in a helmet at me, I'd be feeling threatened.
All in all I think the guy was just an ass, and hoped if he found the right person, he could seem confident, and get her to agree to pay for his flat tire on his bike.
 
I carry 24x7, so have to be careful about getting involved in anything that doesn't directly involve me or my immediate family. For all you knew at the time, it could have been an ex of some sort. That gets real tricky if it escalates. In the case of it not being me or my family, especially if it's a total stranger...the best thing is to be a good witness. Liabilites are just too high nowadays.

In her case, I'd report it to the cops...especially if she got the plate number off the bike (hope so). That way, there is an incident report if he happens to do it again, and it's more likely to be followed up on. Yeah, a PIA to the cops...but might be worth it.
 
I would have called the cops RIGHT THEN & THERE!

#1 - Let's the LEO back his happy @$$ down! Unless a complete imbecile, he won't make threats with them standing there
#2 - It gets HIS name on a report, along with her statement of being harassed
#3 - Should get the CSI (photographer) there to take OFFICIAL photos of any "evidence" (or lack of) that may reside under her Jeep, rather than him claiming the damage was repaired after the accusations
 
In Winston we can go to the cities website and view traffic incidents. If he said when and where he got hit she should have enough info to find who he is (given raleigh has that online tool) and she can file a restraining order.
 
She should still file a report and make an official statement. Filing a report is not (doesn't mean) your filing 'charges' against someone. It just makes it a matter of public/legal record.
 
You have to have injury involved to make it a felony, and it usually has to be serious injury. If it's minor injury the DA wont usually take the case as a felony and drop it to a misdemeanor charge. Property damage hit and run is only a misdemeanor. So the guy didn't know what he was talking about.
NC law only requires a wreck report to be made if the damage is over 1000 dollars damage or there is injury or death. So lets say she was involved in a minor bump up and there was no injury and less than 1k dollars damage than she didn't have to report it. But I always suggest to call 911 and then its easier to work things out the law on scene.
 
OH, sorry if I wasn't clear. She was NOT involved in a wreck. Someone in a jeep hit this guy three weeks ago. (maybe? giving the benefit of the doubt here since there is NOTHING according to the police of a hit and run involving a jeep in the last month)
Today at lunch this guy comes up, and basically accused and berated her, threatening her, with "going to jail for a long time for a felony"
Realistically, if a Jeep hits a bike hard enough to pop it's tire, it's prolly going to do more than "pop" the rear tire on a motorcycle.


That being said, we swung by the Morrisville PD today. Officer was very friendly, took lots of notes, looked at the jeep, even though as he pointed out, if this guy claims it was 3 weeks ago, looking at it now isn't really meaningful. (But he did agree, and note, it looked original, given dirt and bugs on it.)
He was really friendly, and was even laughing about the craziness of the whole situation by the end.
But he agreed we did the right thing letting the police know. He did tell her if she sees that guy again, try and get his license plate, do not speak to him, confront him, or anything, and immediately call 911, so they can try and figure out what's going on. (smart advice)

I just feel like a retard for not noticing the situation and getting a name/license plate, but I was hungry, and it wasn't my jeep? :D
 
If the dude was under the her Jeep I would assume someone litterally drove over his bike with a another jeep (if true). Sounds pretty crazy. Personally I would wip out the camera phone if she spots the dude again. I personally don't believe his story because he left after accusation. I think something else is up. I'm just paranoid and untrusting of people though. Visiting the police was the best move for now.
 
look for cut marks around her catalytic converter....maybe he was trying to be a thief and got caught.

If she admits to that (even if it is a lie) to get him off her back (thinking that is all he wants) that is a bad move (good thing she did not say what he wanted to hear) Insurance company tried to get my father that way, said if he admits to this and that they will drop the complaint and he will pay 2000 dollars for something someone blamed on his plumber.If he agreed it would have open the flood gates to all the other insurance company's who had home owners stuff destroyed
