How does the magistrate not get charged for discharging a weapon into an occupied vehicle? Deadly force cannot be used to protect property.

Indeed, he should have just called 911. To me, it seems like a good way to get killed. Confronting a burglar isn't a great idea, especially at someone else's house. Even if he wanted to follow the guy to help the cops find him, I would be ok with that.
 
I agree with @GotWood. Shooting into a occupied vehicle (or dwelling) is a felony rap.
In NC, shooting to protect property is verboten.
Just sayin...
 
My dad emptied a snub nosed .38 into an S10 blazer a few years back when he owned a gas station in VA. He thought he recognized the guy driving as a previous drive away gas thief so he walked out like he was checking the mail to get the tag number. He walked behind the vehicle on the way to the mailbox notices no tag and on the way back in was angling to go in front of the truck for a frontal view. The guy apparently realizes what's going on throws down the nozzled jumps in and floors it towards my dad. Pops jumps to the side getting kinda bumped/brushed down the drivers side of the vehicle. He rolled clear as he was drawing, squared,planted both feet and went to work. You could see one round hit the tailgate and then the back glass exploded as it went out of the security camera. He didn't report it and never heard anymore about it but we used watch the security footage and laugh at how stupid the whole situation was over 11 gallons of gas.
