I got a seat belt ticket because I’m too short to wear my seatbelt properly and this is America!!

Relatively new State trooper. Not that that matters, but he sure is doing his job to the max.
Hes sitting at the camper place and pulling people into the store parking lot. Store clerks counted 6 in an hour including me, my buddy Keith and store owners wife.

They all deserve their tickets, but I had my seatbelt on!
I had it slipped under my left arm because it rubs my neck. He told me as he walked up, that he now realized I was wearing it, but he was still going to ticket me for wearing it improperly.

179.00 and a court date. I dont have to appear in court if I pay the fine, but would it behoove me to show up and argue my case?
My shoulder harness was less than 2 inches from where it would normally be.

Either way..Whatever dude, thanks for serving and protecting the hell out of me!
 
My buddy got the same ticket once from a local pd officer maybe a decade ago. Ended up having to pay the ticket.

Buckleupnc says "Unless a seating position has a lap-belt-onlt seat belt, both the lap and shoulder belt must be properly worn. Placing the shoulder belt behind the back or under the arm is not allowed." But I can't find any actual verbage in the ncgs to back that up.

Either way, it doesn't carry any points on your license so yeah, it's all about the money--especially considering you were actually wearing a seatbelt. Obviously hiring a lawyer wouldn't make sense financially but depending on your level of upset it might make sense out of spite.
 
Should have been in your booster seat @Dylan W. If you got the time go to court and have it dismissed. Total jackass trooper it sounds like.
He is...been making a name for himself. My first (wife's dad) was a State man, a real good one.

He will calm down hopefully, or like another trooper I knew someone will do it for him.

If I can, I'm going to court just to see what happens. I figure I'll be paying the ticket though. I'm not arguing that I was in the right..I just wasnt all the way in the wrong either. Im thinking that Maybe i only deserve half the ticket.

I've got a lawyer friend that I'll call tomorrow for advice, but I'm definitely not paying her anything.
NCGS 20-135.2a Says in the first section that the occupant shall have the seat belt properly fastened about his or her body.

No problem. Just posting the facts. He should have given you a warning though. That would have been the decent thing to do.

Seriously, hes been at it for 3 days, sitting in the same spot, pulling folks into same store lot. The locals at the store claim hes pulled over 40 or 50 into their lot in 3 days. He waived at me earlier today as I pulled out of store. I couldn't help myself and actually waived back.( I'm a nice guy:D)

It's all just a bit out of the ordinary and makes me wonder what's behind it.

I took it off to get my wallet out of my back pocket, showed him my license, then asked why I didnt have a seat belt on. o_O I told him that I had it on, I had just took it off to get my license out. It didnt matter, he didnt believe me. Needless to say, I still ended up with a ticket.

Maybe dude had a family member or friend die in an accident from not being belted in, and he has a personal agenda on making an influence on this one thing?
But then, id think a warning would accomplish that.

Or, hes just as asshole trying to make a name....

Either way - i find it amazing there are so many people getting pulled for this. I thought this day and age, everyone wore a belt.
 
I only wear a seatbelt in my work vehicle or on the trails. I don’t believe in being forced to wear a seatbelt by the law. I have never got a seatbelt ticket but had plenty of speeding and racing tickets in my time.
 
I don't know if this is a fact or not but I once asked a trooper why court cost was associated with a ticket that I didn't plan on contesting? He did not have an answer. I asked what happened if I wanted to go to court and contest the ticket. Said if I lost I would have to pay court cost and the ticket. The whole cost of the ticket, fine plus court cost and court cost again. Sounds like BS I know but he was very addiment about it. I then asked who I was affecting besides mysel if I had a wreck without wearing my seatbelt? He had no answer. But I ask this, why is there court cost on a ticket that your not contesting. Why not just a fine and go on. As said before it's about the $$$$$. I've paid around 17 myself over the years. Hell I even got one in the Bojangles parking lot one morning, yep cause I didn't have my seatbelt on in the parking lot. I mean what the hell.

you could have fought the parking lot seat belt ticket and won. You cannot be written a ticket on private property. Technically you can drive a car through the parking lot all you want with no driver's license and not get a ticket.

I had no business going to court to fight the ticket. My blood pressure is probably off the chart just typing about it. But the dumbass City cop told me that the city of Apex owned the parking lot. I even asked him to call a superior officer. I don't want to type the whole story but if I had went to court and the officer was there I probably would have ended up in handcuffs in the court room. That was approximately 15 years ago and my blood still boils thinking about. Maddest I've ever been in my life.

Got the same thing sort of in my ‘69 Plymouth Sport Satellite. Back then they had 2 piece belts, a lap belt and a shoulder belt that would clip in beside the lap belt. If you only wore the lap belt the shoulder belt could go along the inner roof line (above the door) to the “holder clip” that was part of the visor. Anywho I was only wearing my lap belt and got pulled. Officer walks up and asks “ are you wearing your seatbelt?”
“Yessir it right here” as I grab the lap belt. He reaches up and feels the other one fastened in the holding position and says “not all of it”. Come to find out he had a ‘69 GTX and knew the deal.
Had to pay the ticket cause I wasn’t properly wearing the seatbelt.

As far as I know, all the court cost are the same, regardless of infraction.. stupid to have to pay $225 on a $25 ticket, especially if you're just paying it and not contesting, but whatever. I've got out of several tickets (tires, seat belt).. to be fair, my seat belt wasn't attached to the vehicle and pointed that out to the Statie. Wrote me a ticket anyway, I showed up with photos & they threw it out. (Made sure to tell him to put a note that the belt was defective)... So for the price of a seat belt you could probably get out of it.
