misdemeanor?

well, I just got the phone call from the sheriff's dept. to come meet them for my criminal case paperwork. . . guess he wasn't bluffing. Anyone got any pointers?
 
You didnt sign a sworn statement, he didnt catch you tresspassing and you were questioned without a lawyer. I waould call back and ask to reschedule due to a scheduling conflict with your lawyer. That may be enough to make them recogonize that this will not be so easy.

I wouldnt say a damn thing because weren't you confused about where he was assuming you had been?? Also if there were no signs (go take pics now!) you thought it was an unmaintained road. These were effective when I was stupid in my younger day.
 
All the tickets I've ever gotten they make you sign them before you leave, otherwise they could just make up all kinds of shit and charge you with it.

If he was telling the truth, you may end up with a court date charging you with making meth on private property using child labor and hookers. Don't know what the legal charge for that would be, but I imagine it would be pretty hefty. :lol:
 
I wouldn't go to the sheriffs office without a lawyer. If you do, you have seriously hurt yourself.

I plan on getting a lawyer, no doubt about that. I'll have to see what I can do about getting one to go with me to pick up my paperwork from the sheriff. Not sure how I'll be able to do that being at work and all.

One thing I am a little worried about are the guys I met out there may have admitted they were out there, I walked up a minute or two after he was talking to them (had to move my jeep). So I'm not sure what they said or if they'd be a witness against me.

How would I hurt myself going to pick up my paperwork without representation?
 
1. I guess I was wrong (happens).
2. Ask a lawyer how you might hurt yourself picking up the paperwork.
3. This is really garage material.

You are assuming you will just be picking up paperwork and walking out, that may not be the case.
 
He's meeting me at a location of my disgression. He said he'd rather meet me at a place that doesn't involve me driving into city traffic. I'll have to admit, this Sheriff has been nothing but very polite and helpful throughout the whole thing. He's just doing his job so I can't hold anything against him.
 
Will he be arresting you for tresspassing? That is what you need to know. Unless there is a warrant for your arrest I would not agree to meet anywhere or anytime unless you are going to be charged with a crime.

If he is not going to arrest you then there is no reason to meet. I would have that meeting in my lawyers office and tell them to bring a warrant if needed.

Why the shit should he care about you driving in city traffic. Something isnt adding up here and I dont trust the boys in blue.

They're just trying to teach you a lesson. Especially true if you're young. Possible the owner has had problems with trespassing, no damage to property - but no trespassing means no trespassing. Odds are with a guilty plea you'll get a small fine, a few hours community service, and probation as long as your criminal record is fairly clean. Possible prayer for judgment depending on circumstances. Everyone who is trespassing (given nothing else was going on) should get the same. Normally it's OK to cooperate with the police on minor issues and come out OK.

Occasionally....

Detectives put words into your mouth and try to pin you with some BS you don't have any idea of... (Someone growing marijuana, some other trespassers from the group had narcotics, stolen property, the property has had damage/theft, the could try to keep your vehicle, etc) Without an attorney representing you (unless you have a solid alibi) it can get ridiculous. An attorney for a simple trespassing charge shouldn't be too expensive.

x2 Franklin - Something does not sound right about meeting in a location.... May not be a big deal ( saving $$ somehow, shorthanded department??). I think I would consult an attorney about now.

No kidding, this is just bizarre. I for one can't imagine a LEO going to these great lengths for a simple trespassing charge.
 
I have no reason to believe that this Sheriff has any malicious intents. He's been very upfront about everything, polite and respectful throughout the whole thing. I called him to see what class of misdemeanor it was and if he had the intend of slapping some cuffs on me. He sounded pretty startled and said it was nothing like that, actually he gave me his word about that. I am being charged-with trespassing, and he just needs to give me my summons. He's calling me back about what class the misdemeanor is, as he wasn't sure. I've had more than my share of run-ins with the boys in blue, or brown in this case, so I'm also pretty cautious around them. This state doesn't pay nearly enough to attract the cream of the crop for law enforcement, so you have to be cautious. But I feel that I'm not being BS'ed by him.

I'm 27, not that young-I should know better
The owner is Onslow Country and the magistrate does not like people back there.
I just got a speeding ticket in a school zone-(not properly marked but I couldn't do anything about it)-besides that a clean record in NC, so my prayer for judgement is probably out the door.

I'd be ok with a small fine, community service, and probabtion. As long as the small fine isn't $1500.

I'm going to at least consult with a lawyer and see what he/she thinks and will probably go from there.

well, the good thing is that you are owning up to the mistake and taking what comes. the bad thing is, another wheel got caught trespassing.

I met with him and everything went well. Again, he was polite and returned the respectfulness. He put it this way-you have a park that closes at 11 but kids keep playing there until 1. Now as long as the kids aren't fighting, being loud, or doing drugs-he has no problem with it. Even though the park is closed. But since there's been alot of people out there tearing it up, he's had to stop it. He's sorry that it happened, but he has to do his job. No issues with that.

On another note, the summons states that he believes there is enough probable evidence to conclude that I was on the property tresspassing, on or around the date that was disclosed. So. . . we'll see what the lawyer says. ..

He just stated that he did not see you on the property. He left it up to you to either go to court and admit it - or lie - in court.

For no reason other than I find it funny when someone enters an Alford Plea.
