New gun laws go in to effect today in NC

guns at work

yeah, my work has a no gun policy that says they can search vehicles anytime they want. They never have, but if they do and I have a gun in the car....Im toast.

Park across the street and walk to work.

I fail to see how your car being on their property gives them the right to search it at any time, but I guess if you signed something waiving that right they can.

Yeah, I have the option of parking at the gate, and that is fine. We just cant have guns inside the gate, even if they are locked up. Every company does have the right so enforce that if they want. I guess the fact that we have 4 billion mmscf of liquified natural gas and other hazardous chemicals on site might have something to do with it.....
 
Just finished my ccw class so they covered the new laws in it. You can't shoot someone for trespassing or over property still so no you can't shoot someone just because they are in your house.

What you can do is shoot them as they are forcing entry or after that there has to be some threat they pose to you beyond just being there. You can't sneak up on them and cap em. You'd need to get their attention and if they run you can't shoot them.
If you find a guy stealing your car and he drives out of your garage with it you can't shoot him either, you aren't allowed to pursue (to shoot or detain). Only cops are allowed that legality.

As the original guy said though you don't have to flee, if you are legally allowed to be where you are you can stand your ground which means the defense can't come after you for that and it expands what your ground means from just your house to your car, your boat, your friends boat etc.

Really though if you knew the old laws just use those and drop the "I attempted to flee" part.

This was as explained by a retired Wake County Sheriffs captain a month ago. He said it wasn't really a castle law, it was better described as a stand your ground law.
 
So how I read this is, you can shoot a perp but only so long as you are in danger.. Thus, you will most likely receive some sort of injury to justify the shooting.. Our laws still give too much favor to criminals! I hate a theif and they should be shot on site regardless of if my life is in danger or not. Let the courts decide the guily party - although they havent proven to be too reliable these days either!
 
You don't have to be injured, you have to reasonably believe they posed a threat.
 
You just have to fear for your life. If the guys running out the door with your dvd player that doesn't qualify.
It's self defense only and someone being in your house uninvited does not qualify by itself per the captain. If you walk down the stairs and see someone in your house you should be like, gtfo and if they act like they are going to do something to you or your family then bang bang.
What you don't have to prove in court anymore is just that you didn't have any other options other than confronting the guy, ie: why didn't you just leave if you thought you were in danger.
The captain gave an example of telling your mother in law to get the hell out of the house. You can't shoot her if she refuses leave. You need to call the cops even though she's now trespassing.

All of that is the same as the old law except for not having a duty to attempt retreat before firing and the new places you are allowed to carry.
