...and as far as the insurance I think I'd do like the drag strips do and make eveybody sign a waiver that comes in saying you guys are not liable for any accidents or damage to your vehicle but I guess that would be something to think about..

this does not completely cover the landowner if someone decides to sue you... I would bet drag strips have insurance to cover their events...

A few I have been to have their own ambulance and rescue on site also.
 
OK coming from someone who does this all the time - no, liability waivers don't much of anything for you - as Ron stated earlier all it does is eliminate the "I didn't know" argument, however does not cover you from negligence, and trust me, there are plenty of ways to be found negligent, once you find out how things actually work, it's quite, for lack of better words, retarded how our legal system really is.

Dragstrips do have insurance, however the ones I've worked with have not been required to have ambulances/rescue on site.
 
Sooo....your best bet is to forget all the insurance stuff and save your money for a damn good lawyer?

I have no knowledge of how this works at all, but just a thought...hopefully someone can pipe in and affirm or neglect or whatever.

I would think that if people signed a waiver and if you posted "at your own risk" signs along every trail, maybe 50 yards apart, but so they were visible from one sign to the next...it would be sufficient for legalities.

It's just like if you have a big ditch in your backyard. If someone drowns in it, you can get sued, but if you have "no trespassing" signs posted that are clearly visible, it makes a lawsuit a LOT more difficult.

Just a thought...good luck with this whole thing...I'm keeping an eye on the thread.

you can break in a house and then sue the owner if you get hurt....it's been done, and the criminal WON.

having those signs and waivers do NOTHING but make the court take longer to pay the idiot.
 
And that's why our society is messed up...kinda glad I'm not trying to be a judge.

Either way seemed like it would have SOME sort of effect for the signs. Why would you not be able to put a line in the waiver stating that the individual will not sue anyone (land owner, wheelers, event manager, etc)? Their only leg to stand on would be that they didn't read the "contract" to which it becomes their own fault.
 
still working on the insurance deal, ...i have talked to Carolina Adventure world, as for the other parks such as URE not having fire trucks or pd on site, and waivers, these parks are state owned and you would have to sue the government if anyone got hurt, and we all know most people wont try to sue the government its an expensive process, where a park that is owned by an individual is different if we were sued they could go straight through the insurance and sue the owner and possibly take all he has...

yeah man, liek we have said before - call up some people that have PRIVATE parks, none of them have EMTs on hand. E.g. Rausch Creek, Gulches, etc.

sorry it has been a busy week, i am reading all of your post and talking with lawyers and insurance agents. we have found a cheaper insurance rate, but the insurance still requires us to pay per event not for a 7 day a week business, and require one fireman and emt on site at all times. URE gets away from it because they are state owned, carolina adventure world has 2 employees that are EMT certified and one volunteer fireman working there, that is how they get away with it. The Carolina speedway is run by a man who works for me, i am working with their insurance company to see what they can do on a 7day a week business. I will continue to keep you posted i am open to any ideas or advice any of you have and i will be calling all of those who offered advice in the coming days. thanks again
 
Sorry if you've already mentioned this in an earlier post but where exactly will it be opening? Near Hickory doesn't say much. Hickory's smack dab in the middle of a lot of places like Granite Falls/Hudson, Lincolnton/Maiden/Newton, Statesville/Mocksville etc etc Let us know!

I think you are wasting your time talking to those other places. You need to deal with an insurance company that works with motorsports 100% of the time...

yeah, i agree with rockcity...your focusing your efforts on insurance in the wrong direction.

Who ever you are talking to does not understand what you are doing, so how can they come up with the best plan for you.

I was on the phone with our insurance company today. While I was talking to them I asked about private 4x4 parks and they do handle those WITHOUT fire and ems on-duty requirements.

You will need a detailed execution plan, safety plan, etc., but its all typical stuff they deal with all the time and can walk you through their requirements. :)

They insure people in all 50 states, so you wouldn't have to fight with a local agent to find an underwriter that is licensed in NC for your type of operation (I've been through all of this already...). This was key with us as we are running events in multiple states. You, not much of an issue but they are licensed for insuring in NC.
