police codes

When I was in San Antonio, TX, I got a ticket for not stopping at a Yield sign. The cop was getting off the exit about 100 yards behind me. She was pissed that I didnt yield to her.

What ever happened to Inocent until proven guilty! The courts make so much money on faulse charges. I think they should have to pay us for lost time at work when charges are inaccurate.

No such thing as a quota where i work, or anywhere else I've heard of. I have heard that Highway Patrol gets a nicer car (slick top, unmarked, etc.) if they write more tickets. That's probably the closest you'll get to a quota in NC.

The cop is probably not going to appear. We have a sepearate Infractions court date, which we do not go to. We only go to District Court for misdemeanors and Superior Court for felonies. The courts are so busy they have a seperate day for all the b.s. tickets, and the judge is not going to waste a lot of people's time trying every ticket there is. You'll probably get off with improper equipment or something of that nature, just don't lose your cool in court.

if the officer wrote "p42" in the speed block of the ticket, i believe he wrote the wrong code if he either paced or approximated your speed. "p" is for pursuit, according to the codes on the front of the ticket book. "r" is for radar, "a" is for approximation. Does this mean the DA will dismiss it? I don't know, it's up to the DA. the onus is on the state to prove the charges.

second, i won't pretend that all officers are experienced, fair, good officers. i don't think anybody i've ever given a ticket to was happy about it, and i think most people have what they perceive as a bad experience with the police. i do think that what a lot of people fail to realize is that we never know what will happen on a traffic stop, just like a domestic, or a warrant call, or a robbery, etc...i've been riding down the road with nothing going on and the next thing i know i'm face to face with a drug dealer with a shotgun in the street who was just in a shootout. for that reason the officers may do things that you don't understand, but they should all be within the framework of the law and their departmental guidelines.

lastly, i don't really expect to change peoples minds with this post, and i really don't want to be flamed...but, i have two pieces of advice for folks... if you've had contact with the police and feel like you were truly mistreated...contact the supervisor. secondly, do a ride along with your local department....do it in a high crime area....i think it will open your eyes a little to why police do what they do....
 
I have total respect for the job our LEOs do.
However, I find it inexcusable that he wouldnt asnwer your questions, especially if maintained your composure and spoke respectfully to him.
 
If the officer didnt' explain it to you isn't that an infraction of the miranda (sp) code or something of that nature? Since technically the citation was issued in leiu of arresting you, I was under the impression that it was the obligation of the officer to explain the infraction.

Speeding is an infraction. An infraction is a non-criminal violation of the law. You cannot be arrested for an infraction, and Miranda only applies when someone is taken into custody in criminal cases.

50+ hell I used to do 60 to 70 thru there when i was running errans and stuff. I knew it would be a place for cops. I am glad they didnt catch us back in the day. :) Sorry to hear about that studnuts. Thats crazy and its BS I wouldnt even worry about it. They will dismiss that and the judge will probably eat that new officer for lunch. Go dressed up in a suite and tell him that you always try to be careful and safe in that industrial park. 1 MPH is damn ridiculous. HAHAHAHA!!!

Just play the game...everyone (officers included) knows the drill....Get an attorney and pay some fines..the safety issue is bullshit for the most part as long as everyone involved gets something out of it , be it cash or otherwise. It's not really fair but that the way our tax department..ugh... I mean our legal system works.

apex cops are pritty rough people i try to stay out of apex as much as i can if u blink the wrong way they will get u. regardless of what happened if u were really only doin 1 over the DA will laugh and thro that out.

Miranda rights are given once they place you under arrest. I believe they dont even have to give your rights if they just put cuffs on but arent planning on arresting you.

As many others have said, go see the DA. They wont want to deal with a 1mph over infraction, thats alot of work to do.

Ive found that dealing with officers in a respectable manner, rather than getting all in their face and pissy about the ticket, whether you think its right or wrong, is always the best option.

or radar calibration error, or estimtae error, Id use a term that throws the onus off myself.

Well, P-42 definitely means paced@42mph. Cops only explain this stuff if asked. My first ticket was P47/35, but I didn't ask, and so I had to figure it out.

Possibly noone knows what it means. I know when I was pulled, he did not have to Pursue me, nor did I get charged with running from the cops. Just because somebody says they know something on the internet, doesn't mean they do (myself included).
 
I don't doubt you. OTOH, Im speaking from personal experience. I believe it comes down to the officers application of the lettering, and it may not always be correct. Or, they may interpret P=pursuit to mean that the pursued you to get your speed.
