From the years of being an HVAC guy, I've seen this way too often. If the home owner tells us "no toe kicks", we have to make it work wherever.
That boot really shouldn't be that close. A good guideline for cutting them in is 4-6" from the studs and that typically allows room for any drywall thickness plus molding.
It could be made to work with base notching though.
 
First day on the job for my new office manager. Not sure if it’s going to work out since she snagged my lumbar pillow as soon as I got her desk set up.

There is a picture of me in a Mtn bike singlet and no shirt that was taken today.
