From the years of being an HVAC guy, I've seen this way too often. If the home owner tells us "no toe kicks", we have to make it work wherever.My competitors have stepped up their game.

That boot really shouldn't be that close. A good guideline for cutting them in is 4-6" from the studs and that typically allows room for any drywall thickness plus molding.
It could be made to work with base notching though.
