So CNN just dumped the first recording on us between Trump and Cohen. Initially, things look BAD for old Donald. He acknowledges that there will be a payment to that guy about that thing. So I listen to the whole recording, and things start to look bad for Mr Cohen. (in my less-than-law-school-education impression).

Here's the rub, as I see it:

So, there is no indication as to where the conversation took place, which is relevant to determining if Donald's consent was needed to record him. Taking a scientific-wild-ass-guess, I'd figure it took place in New York since he lives there and Donald has a lot of business dealings in New York. Well, New York is a one-party-consent state - which looks good for Cohen..........


Except that in the tape, there is a side conversation that is recorded between Donald and another party that has walked in the room to interrupt the conversation. That means that Cohen recorded a conversation to which he was NOT a party to....... OOPS!


What say you, oh NC4x4 legal scholars?

Frankly, I dont really care if he screwed her. And I dont care if he paid her off to keep quiet. There are a few reasons as to why I dont really care.

1. Not my dipstick, not my wife, not my problem...

2. He was not president at the time of the erm, encounter.

3. Other than the left trying to sling $h!t, it has exactly zero bearing on his presidency.

4. Nothing in the tapes indicates anything illegal transpiring. Is any of it "right" by my moral compass? No, not really. Do I think everyone has to live by my moral compass? Not a chance. If anything happened, it was clearly two consenting adults, and all parties involved lived to tell the tale, even if the werent legally supposed to...
 
I'm not sure what they are trying to get at besides a captian obvious award - Billionaire bangs models, holy moly! If he used campaign funds to pay for it, there's a problem, but you'd think by now they'd have that part figured out. The whole "we have 12 tapes!" coupled with the slowly leaking them one at a time really does nothing for the credibility of the "illegal" claim, as it only serves to draw out the reputational attack for the sake of a reputational attack. And his reputation is shit already, especially to those who aren't his fans, so I don't really get it. It's exhausting and it really serves nobody more than the president and keeping bullshit on the front page and essentially buries any other potential "real news".

On a semi-related side note, I think one of the reasons the economy is doing so well right now isn't that his policies are amazing, but that Trump keeps all the heat on Trump, and corporations can pretty much do whatever as he doesn't seem too interested in bolstering the various regulatory agencies. So the heat and eyes are off of them and they feel confident because of it.

Now, if he used campaign funds or lied about it under oath that's another thing.

FWIW, I hate that motherfucker. I like some of what he's done but damn he's such a massive douchebag asshat.

- Not a legal expert, but I don't think it is a legal concern that there was a recording of that second conversation between Trump and the 3rd party, because (implied) consent was given already to Trump by being on the call. When the 3rd person walks in, it's essentially a 3-way call at that point. Trump was still there. It's not like he hung up the phone or muted it and still had the recording take place. Just like a 3rd person walking into your conversation, if you don't shut up or walk away then that new guy is now part of it.

But what I find most interesting is that the release here either shows that Mueller's team really are idiots OR really are not specifically out to try and trap Trump, and also that CNN is not smart enough to play the long game.
By letting knowledge of these tapes out, and especially releasing to the public, it shows their hand and what info they have on him. If they wanted to nab him on a perjury charge, they would keep this shut tight, and ask I'm under oath about it, wait for the lie, THEN provide the evidence of the lie, so he could be charged. Now instead he knows what they have and if he has half a brain, won't lie (which, well, lets face it, may be hard for the guy b/c it seems to come instinctively for hi mto deny everything) or he'll just plead the fifth on everything.

It's just funny to me how left-leaning people/orgs are so hungry to spill dirt on Trump that they haven't figured out that if they just keep tight lipped long enough, and sit back and wait, he will inevitably bumble into breaking some law on his own. It's clear he's learning where all the legal boundaries are by just pushing against them as he goes along, not having had any experience w/ working in the Federal system OR having a team/cabinet of people who do, he's just doing what he wantes until getting negative feedback and then knowing where to stop. It seems if they had not been so eager to bring up all this stuff from his candidacy, and just waited longer he would have likely broken some much bigger law. But instead, now he knows he's under the microscope for everything.

In short... CNN et al are blowing their wad way too soon and missing the real opportunity they want so badly.

Youre right. Being an outsider, he has no clue where the lines between politician and Clinton are. Being that he clearly likes to push the bounds, he likely would have ended up suicided.
 
Trump has become a huge embarrassment. He is not fit to be the president, but then neither was Hillary.

I beg to differ. Trump was a private individual who had consensual relations with other adults. Bill Clinton was repeatedly accused of sexually harassing and raping women while in a position of power and influence. Harvey Weinstein has nothing on WJC when it comes to hierarchical abuse of power.

Just because the TV tries to make it out to be a big stink, or tries to spin the muffled and mysteriously cut audio that Trump was saying pay cash (Which some talking heads are trying to mean proves his automatic guilt of... being a mobster or something) doesn't mean any of this matters.

The scenario is simple and common.

Man is popular.
Ex-GF comes forward to act like an... Ex-GF. She says she will spread truth/lies/semi-truths/scandalous/salacious things to the media.
Man realizes this will hurt his popularity. And doesn't want to deal with the drama and such to shut her down and prove her wrong.
Man gives her money to go away.
She signs documents, pockets money, and goes back to Gold Digger Ho-tel.

Nothing illegal about this, and nothing unusual. It's very common.

I did find it funny that they made out a cash payment to be some kind of mobster tie. Ummmmmmmmmm didn't Obama send a whole plane full of pallets of cash to Iran to "buy back" some hostages? That wasn't figurative "cash".... that was actuall cash!

Nothing illegal unless she signed a contract to not tell, in which case its a breach of contract. Why does the left care so much about Trump's dick?

And normally it is, they've destroyed numerous Republicans by exposing affairs in the past. The right tends to care more about things like morality more than the left. Whenever one on the right side strays the path, they usually get ruined, shamed, or voted out of office. The left... well - they walk on sewage like Jesus walked on water. Ted Kennedy, JFK, Bill Clinton, Anthony Weiner, Robert Byrd, etc.... The turds of the left float to the top. ;)

But we all knew Trump was a playboy when we voted for him. So this has zero effect on us.

Really, we would be shocked if this sort of stuff HADN'T happened.
