So CNN just dumped the first recording on us between Trump and Cohen. Initially, things look BAD for old Donald. He acknowledges that there will be a payment to that guy about that thing. So I listen to the whole recording, and things start to look bad for Mr Cohen. (in my less-than-law-school-education impression).
Here's the rub, as I see it:
So, there is no indication as to where the conversation took place, which is relevant to determining if Donald's consent was needed to record him. Taking a scientific-wild-ass-guess, I'd figure it took place in New York since he lives there and Donald has a lot of business dealings in New York. Well, New York is a one-party-consent state - which looks good for Cohen..........
Except that in the tape, there is a side conversation that is recorded between Donald and another party that has walked in the room to interrupt the conversation. That means that Cohen recorded a conversation to which he was NOT a party to....... OOPS!
