Taking fire, how would you handle it?

I have nothing to add...other than I’m absolutely shocked that someone shot at you and ‘nothing can be done’. I would have assumed that’s assault with a deadly weapon. Pointed at you, shot at you...that’s intent.
I was surprised myself that his weapon wasn’t taken at the least I wish I could get a recording of the 911 call dispatcher says “sir stay calm” I said ma’am I’m reloading a magazine I called you all for his safety to be honest bc if he continues to fire I’m hanging up and returning fire to get to better cover away from my house, that’s when I told dispatch I thought it was a shotgun but I’m not gonna chance it...

They assume if some one shoots at you from that distance with a shotgun it's just to scare you, and didnt actually intend harm.
Although being hit from long distance with a pelt from a 12 gauge is no fun. Damn tetanus shot hurt like hell.

I guess all I really should add, is @C.Berry take care of you and your family. Hopefully this all has a peaceful resolution.
 
Definitely think he crossed a line shooting across property lines...doesn't matter if he was shooting near you to scare you or at you to hurt/kill. I say file with the magistrate to get it on record & hold off shooting for a week to let things cool down. Then go talk to him & if he is reasonable you could offer that door you mentioned or let him visit your range as a peace offering. Every time you use that range from now on I'd get it on film with one camera filming you & another filming his house. At least then if he does anything else it won't be your word vs his.

I guess I assumed he moved closer since original noted distance was over 500ft away through trees and pellets ended up hitting within 25ft.

Officer said it was he said she said basically even tho I have shotgun pellets on my property on backside of my firing range berm. yeah I told him I was seriously damn confused how that could be but I was in a very bad state of mind that day and didn’t Carry on with the Leo or target practice I just wanted to make sure they knew what went on and to see what options I had!

He did in fact move closer from where first shot was taken. The ole lady seen first shot from the bottom of steps on his porch I seen his upper part of his body moving closer to the tree line that’s when I moved down and around the small ridge while reloading and second shot somehow got pellets down through all the woods... then I was on phone with dispatch with binoculars seeing if the was still closing the gap!
 
I have no idea why you are giving him any kind of a pass! (The cops included) Old or not, someone shooting at you is serious business! If you want to talk to him I would have a cop go there with you. You may be disturbing him for some reason or with your shooting but it seems clear that you have a range.

But, I had a neighbor who would randomly go outside and blast of 15 - 20 12ga rounds almost everyday just for fun. I guess it was stress relief but damn, it got real freaking old after a week or two. He is gone now so it's ok but dayum, my wife was pregnant at the time and I'm pretty sure if he had still been there when the baby was born, had he started shooting during a nap time, she'd have killed his ass. (I'm not an idiot, shooting at people is bad mmm'kay? I realize that and would never condone it)

I dont know the set up of your range in relation to his house, but to keep noise down at his house and to give you some cover. Maybe make a fence between where your shooting and his house to redirect the sound. Also if he shoots at you again you will be able to see the pellets stuck in the boards making it hard to deny.

As far as taking legal action against him. Think about it this way. What if your family was down at the range with you. What if they made it through the trees and hit you or them. What if he switched from bird shot to buck shot. The leo should have done more than what he did.

At an absolute bare minimum:

Reckless Handling of Firearms (Section 18.2-56.1)
Any individual who (1) recklessly handles a firearm and thus (2) puts another person’s health or person’s property in danger is guilty of a Class 1 misdemeanor. Section 18.2-56.1(A). Thus, an individual guilty of recklessly handling a firearm faces up to 12 months in jail and/or a fine of up to $2,500. Section 18.2-11(a).

I agree he did cross that line no doubt, but he does has a wife that’s elderly too and I don’t know if I can lock a man up and his wife be needing help daily if she can’t care for herself...

This makes no sense to me. I understand you having some compassion for his wife but this cocksucker was shooting at you and according to your account of the story he did so for no justified reason. You should definitely take any all legal action against this old piece of shit that you can and also I would give up on being nice and not wanting to hurt him. If he is shooting at you, then it is a matter of self defense and the defense of your family. Shoot back but with accuracy. For the record, I am not a person who likes guns, but I would sure as shit use one if I needed to and it sounds like you need to.

For sure. Like I said, shooting at someone is never ok. But popping off a few hundred rounds near someone's house is not exactly courteous either. It may be perfectly legal, but it's not the nice neighborly thing to do either.

When I was staying at home...my 12 month old at the time napped at 3-330 for an hour or two every afternoon. My neighbor (was on good terms with him) had just gotten a new motorcycle, obnoxiously loud...he'd pull in between 330-4...rev and carry on for 5-10 mins. His shiny new toy, I get it...after a week of it though, and waking up my daughter every time...I went over and chatted. Usually my size alone is enough to deter someone, he obliged to me asking him to quit...until the next day and a couple more days following. Did I mention he gets home early because he leaves early, and when he leaves early he manages to do it quietly enough to not wake us, or his young kids up. Well, one particular night at 2am, I was just so doggon overloaded with testing and tuning my rigs plus a couple engines on run stands, and what's a guy supposed to do but run those engines and rigs at WOT to make sure the tuning really makes a difference. Amazingly, I didn't know when he got home the next day, and when I saw him in the yard later that evening, he tossed me a beer and we had a good laugh. I probably broke every sound ordinance the town has, and had a couple other pissed off neighbors...but my daughter got her afternoon naps from then on out.

A friend of mine lives a short distance away from a subdivision out here in the country. Some guys in the subdivision were target practicing or just shooting too late for his liking one night and he had had enough. He has his federal permits and a nice safe shooting are behind his house. He grabbed one of his full auto's and stepped out back. He proceeded to empty the magazine in no seconds flat. He turned around laughing and said "if they're going to shoot dammit I'm going to show them how to shoot!" They didn't fire amother shot :lol:

Before I spent the time/effort into building my range with proper backstop etc, I made it a point to go to both of my neighbors with my intentions. This was just a common courtesy on my part but it went a long way towards easing any uncertainties that they had. In the end, I was going to do it because I was well within the county rules/regs for shooting. Whenever I had friends over to shoot, I'd let them know. Before this incident have you spoken with him? Also, weren't you the guy that had questions about backstop issues? Is your range facing his property at all? I'm not excusing his behavior at all, just wanted some clarification. Im surprised the officers didn't care enough to do anything about it.
 
In your first post you say he has yelled and cussed @ you and you ignored it. I don't agree w his actions, but if a neighbor yelled @ me for shooting on my property or anything else I would have spoke to him the first time. Then I would find out what his problem was and maybe reach an agreement about my shooting, certain times or days etc. so they could expect it instead of random shooting anytime. Hell I might even invite him to come down and shoot w me if he wanted to. I also don't know why he hasn't come to talk to you about it when his yelling didn't work. I know some things about old crotchety men, many of them just don't give a damn, ain't afraid to die or go to jail, and some can't be appeased and just need to be left alone. Maybe you could speak to him in person or on the phone or mail him a letter.
Maybe you could do some favors for them and work it out or become friends.

Lol yeah that would be annoying but I’m 178 yards from his house 100 yards is legal in va near dwelling and I rarely shoot 150 rounds in a day that’s typically only if the kids are target practicing also! I don’t know if him or his wife are sick honestly I’m being presumptuous and apparently a little to caring! I myself shoot on avg 3 days a week never do I shoot non stop just emptying mags! Almost every shot I take is a single shot or double tap from holster in my edc position and then holstered and repeated! I do sometimes do a 2 shoot with msg change and single round afterwards, so where he came up with full auto bs I have no idea... I’m not being a dick by any means I appreciate everyone’s input on this bc it is serious but In all fairness I pay my taxes and pay for my property to be able to shoot on regardless if it’s annoying I do have respect for most of my neighbors tho and expect the same in return! He could have came to me in person and I would have figured a time or certain days that would be better for them I reckon but I really don’t feel like I should have to! Now his house is directly 91 yards from my NE corner of my house my range is over 100 yards from any dwelling actually closest one is our rental property and it’s 110ish the rest are 140 yards+ Tho I showed all this to the officer as well from my gps standing at the range.

Yep that was me and backstop berm has been put in place! Tires and dirt filled I have spoke with him before not about a firing range but about a old truck I have he wanted doors off of! all the other neighbors know I shoot and know I have a range he is just a dickhead to my understanding to everyone and has been for 30ish years! All our neighbors are family and closest neighbor has 15 Hunting dogs my other neighbor has shot with me before the other ones just don’t care really! And it’s strange my range is 50 yards from my house our 4 month old sleeps through every range time I’ve put in since he’s been home! The direction my range is facing has NO HOUSES in direction closest one is over 230yards with a elevation jump of over 100’ish and it’s a hunting cabin which I have gotten written permission to be on that property if needed to retrieve a Deer and to hike with the dogs!
 
Invite a few LEOs over to shoot next time. Once he fires at them, game over.

Down in my area I have about 3, 4 or 17 that know me on a first-name basis that if I made that offer to they would love to come out and join. The only issue there is if I had a few acres of land with a gun range they could double down and said they have a few hundred acres of land the state just purchased for them to shoot guns and dick around on, so the offer usually goes the other way. Those brand new Warns aren't gonna test themselves. A DNR buddy of mine, just this weekend, was looking at the bullet hole in my truck and said point blank, "I woulda just shot the radiator". :lol::lol:
They know Xjsavage well.
