what would you do ?

yes I have talked to the seller sent him pictures of what I have found he knows this motor was not rebuilt correctly I have to believe he did not know up front that there was this kind of problem with it. I cant prove that anyway, that said he has not offered to refund anything or help make this motor right as of now. I will talk to him one more time and see what he says when I have a price on fixing this motor and be assured if he leaves me hanging after what I payed him for this his name will become public.
so far it sounds like he standing up for himself let us know if he does not help I think if he has talk to you and said he would pay for the fix then he is a MAN and :beer: to him
 
Have you even talked to this guy to try and work something out...or is this site the first place you came to bitch? Either way, I say lesson learned for the future so you don't get yourself in a predicament like this again. However, I know the majority of folks here are stand up guys that would at least attempt to make this right. In the end, you were mislead, but can only blame yourself. You need to look out for #1 to cover your own ass regardless of how trusting you want to be of people. If you were intentionally mislead, good luck getting anything back, if not, you may stand a chance.
That being said, the seller doesn't have to do anything, but I believe it would be the right thing to do.

It depends partly on how the item was represented. There's "rebuilt" and there's "the previous owner told me it was rebuilt". Two very different statements.

I've sold things before which the previous owner told me had been rebuilt although I had no paperwork to prove it. In those cases I always tell the buyer that it was "rebuilt according to the previous owner". I go so far as to tell them that I have no proof and that all I can guarantee is my own experience (which has always been that it ran great for me, it runs great right now to the best of my knowledge, and after you hand me the money I'm done with it.) I think that's pretty fair although I will be more diligent about asking for paperwork in the future just to protect my own ass.

As a buyer I would be weary of "the previous owner told me it was rebuilt" and it might prompt me to be a little more thorough in checking it out.

Both of the guys seem to be against you but where is the sellers post??? How was it sold to you?
 
I ask the above question because I recently sold a boat motor via a high performance boat website and kinda going through the same thing from the sellers side. I sold a good running 22 year old Mercury 200 outboard to a guy in Canada, offered test ride, test run on a stand, etc. New guy got it home and motor did it run and wanted money plus travel expences back. Complete BS as the motor ran the 2 days before he picked it up and he did zero to inspect motor before he left on the 22 hour trip. Motor ran and will run great. How was it listed for sale and sold to you?
 
Again I think it goes back to how you want to be treated. If you like paying alot for nothing or recieving junk for you money I guess its ok. BUT I don't and by the size of this thread in 24hrs I would guess no one else does either. I TRUST the people I've meet on this forum and enjoy selling and buying stuff here. If it comes to the point where you are looking out for #1 only and not the community your dealing with you might as well call it NC4x4CL and allow spam and scammers.... IMO... I did see where other wed sites rate sellers(not sure of the added cost).
 
Rating sellers and buyers is an awsome idea. ls1tech.com has that. And its nice to know who your dealing with based in other peoples dealings....
