Road use tax. When I was looking into leagally setting myself up to do bio at home the goverment wanted to know how many gallons you produced to know how much you owed in taxes, yes you got a break for alt fuels but basicaly paid it right back. It mau have been a little different because it was for my business but I finally decided that it was worth it to me....
edit... right now it's at 38.9 cents per gallon, do the math it ads up quickly and that is why they are cracking down on this too....
 
It's not as long as the taxes are paid on it...


I was told to save past fuel receipts to prove you are legit w fuel.

To my knowledge they can stop any diesel anytime to "check" . Kinda like a license check. Ive never been checked but my boss man has been twice. Once on interstate just going home. A second time w a trailer on a secondary road. Both times were random stops by SHP. He has a stock 08 crew cab Duramax.

So how do they tax electric cars?

Isn't road use what your tag tax is for? Trucks pay for a heavier tag because they put more stress on the road. Hell, my 1500 gasser costs more just because it's heavier.

Seems to me the government is fishing for a fuel tax when they are owed none.
 
I understand what you are saying. The more I asked, the more different answers I got. This was 3-4 years ago and total electic was new and under a new tax break. Who knows.... The 120 gallons I go threw a week(just in the tool truck that I pay for a 21,000 lb tag for) and the 80-90 gallons a week I put in the excurison ads up to alot of tax at 38.9 cents.
 
Huh? You do realize every gallon of fuel bought at a gas station in nc pays a hefty state road use tax? There is no way to collect that on homebrew, hence the problem.
 
I have been pulled 3 times in a a month within a 5 mile radius from home; same trooper everytime. I got pulled this morning and laughed in his face. His "random check" is more like harassment at this point.

I understand he is doing his job but I have a unique looking truck and find it awful hard to believe he doesn't remember me when I've been pulled on the same stretch of 485 everytime!!!!

You also pay a .03 cent per dollar road use tax when you buy a car in NC.
So you're taxed when you buy the car, when you buy the tag, and when you buy the fuel...even if you make our own fuel. :rolleyes:

I'm all for more dirt roads. Maybe I'll write my congressman.

Wow no shit. On the side of a busy highway for something like that. Have you just said "no you can't put anything in my fuel tank"? I think I would be pretty livid...
 
So for years I've heard all kinds of differing stories on penalties and checking of off road diesel, finally just read the statutes. This is ridiculous... I feel like I would have to go on a rant about sitting on the side of the highway when fuel ten miles south is $.35 cheaper, I--unlike all of the states surrounding us have to pay to register each of my trailers, THEN I have to pay for the weighted tag on my truck just to haul those very trailers and you're here harrassing me instead of the mexican pulling two cars behind a tacoma?

§ 105‑449.118A. Civil penalty for refusing to allow the taking of a motor fuel sample.

A person who refuses to allow the taking of a motor fuel sample is subject to a civil penalty of one thousand dollars ($1,000). The penalty is payable to the agency that assessed the penalty. If the refusal is for a sample to be taken from a vehicle, the penalty is payable by the person in whose name the vehicle is registered. If the refusal is for a sample to be taken from any other storage tank or container, the penalty is payable by the owner of the container. (1995 (Reg. Sess., 1996), c. 647, s. 41; 2007‑527, s. 16(f).)

§ 105‑449.117. Penalties for highway use of dyed diesel or other non‑tax‑paid fuel.

(a) Violation. – It is unlawful to use dyed diesel fuel or other non‑tax‑paid fuel in a highway vehicle that is licensed or required to be licensed under Chapter 20 of the General Statutes unless that use is allowed under section 4082 of the Code. It is unlawful to use motor fuel or alternative fuel in a highway vehicle that is licensed or required to be licensed under Chapter 20 of the General Statutes unless the tax imposed by this Article or Article 36D of this Chapter and the tax imposed by Article 3 of Chapter 119 of the General Statutes have been paid. A person who violates this section is guilty of a Class 1 misdemeanor and is liable for a civil penalty.

(b) Civil Penalty. – The civil penalty is payable to the agency that assessed the penalty and is payable by the person in whose name the highway vehicle is registered. The amount of the penalty depends on the amount of fuel in the supply tank of the highway vehicle. The penalty is the greater of one thousand dollars ($1,000) or five times the amount of motor fuel tax payable on the fuel in the supply tank. A penalty imposed under this section is in addition to any motor fuel tax assessed.

(c) Enforcement. – The Secretary or a person designated by the Secretary may conduct investigations to identify violations of this Article. It is not a valid defense to a violation of this Article that the State is exempt from the tax imposed by this Article. (1995, c. 390, s. 3; 1997‑60, s. 19; 2003‑349, s. 10.10; 2007‑527, s. 16(d); 2008‑134, s. 51.)

So if I'm reading the last line of the statute right, the state can do it, but you can't use that in your defense?
 
I've heard they can tell a difference in the smoke that leaves the pipe. Don't know if there's any truth to it though.

I have "heard" they can see a red tint to the soot on the exhaust pipe...I call BS, I noticed no difference in the black soot on the tailpipe of my Duramax or Cummins trucks that run undyed fuel to the black soot on my JD and Ford diesel tractors at home that run red dyed off road fuel. I think it is just an "excuse" to find probable cause, because their "trained" eyes can see it.

Not sure on the electric car thing...but you pay road use tax on every gallon of gasoline or diesel fuel you buy...Ever notice why gas in NC costs so much more than gas in SC? Because NC has a $0.395 gas tax on top of the federal $0.184 tax. SC only has a $0.168 per gallon tax on top of the federal rate. They are going to go after their taxes anyway they can, if you add that up to $0.579 per gallon, that is about $23 in lost revenue in one 40 gallon fill up, and there is no telling how many times you have filled up with the untaxed diesel, so they penalize you.
 
What if I didn't refuse..but requested he show probable cause BEFORE dipping my tank...

And Shawn, I know...FIL owns a trucking company....I just think someone with enough time, money and lawyers could cause lots of issues with that law I woudl think.
 
So I saw a post on facebook this morning another Rowan county guy got his pickup truck dipped on Airport road. Cop said he was stopping any and every diesel he came across.

the electric car has a fee at the manufacturers pay to cover lifetime loss of fuel says. thats one reason they are so price non competitive.
 
So What says when this SOB is dipping your tank (assuming he is not diesel mech) That a part falls off , Said part gets suck up into your Injection pump.



I think if they ask me I would let them no problems, But if they pull me over and just walk up and dip it with out letting me know.. Yall be hearing about me on the news .. I love my old truck
 
We sell the GEM electric cars here at our dealership. (Gem is a HUGE PO:poop:) The consumer pays the normal North Carolina .03 cents per dollar road tax, but gets a huge Federal tax credit for buying it.

Polaris just bought GEM from Chrysler, must be some money to be made and tax credits for the manufacturer.

You still get fined. Although states vary on the state road use tax, they all share the same $0.184 Federal tax, off road is not legal on the road in any state.

Locking gas cap...if nothing else, waste a few minutes of his time explaining to you what and why he is doing it before you give up the key.
 
I keep hearing "Probable Cause" in these post... I am telling you for a fact, They dont need it. They are not bound to the same constitutional rules as normal Police. Even the Federal Marshalls and HLS dont have as much search and siezure freedom as these guys. They can pull you any time for any reason and there is nothing you can do about it. It is a hold over from prohabition and has been burried under miles of red tape and has way too many "road side" Interpretations.

When I worked for CAT I would get stuck hauling demo equipment from time to time. I was hauling a D8 dozer one day and went through the scales. Going down the ramp a DMV guy was standing there and flagged me down. "Hey, we are collecting money for our charity, would you like to contribute"? I looked ahead and there were 2 DMV cars sitting there idling just ahead of me. Waiting. I threw a five in the guys hat and when I pulled off I saw him give a wave to the waiting cars. I did not have to use much imagination to figure out what was gonna' happen if I chose not to contribute. I would have gotten lit up for something, real or imagined. Thats how these guys roll.
 
I have been pulled, weighed, and dipped. Not a fun process when it takes 45mins to do the whole ordeal. Not to mention when they pull you over they open your BACK DOOR and look through your truck without asking permission. I was hassled for having a paintball gun in my back seat because it was "too aggressive". Total ass clown.

Not to mention he had to "HAD to weigh me" even though I had 26,000# on my plate and was pulling a single car trailer with my buggy on it. I grossed out at 13,000#. He could not guess within 13k# that I was under weight. Idiot.

These guys either need to be trained better or get off the highway.
