I like this article but the only thing I do not agree with is if someone enters your home but appears to have no weapon and is there to steal your tv, you may NOT shoot them.... Im sorry, let me ask the nice man breaking into my house whether or not he plans to hurt me or my wife.
So what I take from this is...don't give the bastard a chance to break down the door or bust through your back window...shoot him and shoot him dead.
How do I know if this person has the intent to harm me or not?
You know, how does the law apply if your in your car and someone tried to car jack you...do you have the right to shoot them or at them if they enter your car? or does it have to be in the process?
I mean, Its to the point to where, Im going to shoot first and ask questions last.
I don't believe in giving anyone who has the balls to break into my house a chance to tell me they meant no harm to and they just broke in as to not wake me to check out what color carpet I have.
 
Break into my house , or walk into my shop , I see you in either without permission law is in my hands.

The legal system in this country is worthless. Hot lead works best.
 
thats what Im saying...Im not gonna give the person time to explain themselves and possibly cost me my life or my wifes'

Just like the dad who shot that 17 year old boy who was in his daughters' bedroom....dad had no idea who or what he was doing there...he was an unauthorized person in his house....just too bad the daughter got the boy shot....

If they are in the act of breaking in you have more rights than once they are inside...

If they are inside always fire a warning shot. If they keep coming then you should reasonably fear for your life. If you are the only living person at the scene its hard to determine which shot was the warning shot #1 or #2...;)

I've seen it somewhere.... " I carry two guns - one for me and one to put in the dead guy's hand..."
 
My conceal carry instructor told me that if a person is in your house whatever and they have their hands up and you shoot them say in the chest....they can determine that the person was surrendering and that you shouldn't have shot the...
so he says, if they put their hands up....wait for them to put their hands down and fire away :)

But Im saying, if I walk in my house and realize that I am in the process of being robbed....law says you cannot shoot them if they are walking out with your stuff....

Im just saying, I pray that noone ever comes into my house uninvited especially at night. My wife has joked about trying to scare me at night and I tell her not too because I can't afford this house payment by myself :)

Thats what I was wondering....something about forensics is what he said...I dunno how true that is, but thought it was interesting nonetheless.
 
The article states: "If there is no sign that they are armed, you may not shoot them" and then states "The basic rule is that you must be in fear of losing your life." I think the second point is the most crucial to prove. Considering how many people are killed at the bare hands of another, I don't think a weapon is needed to show fear of losing your life.

the key is no matter what happens.. if you shoot someone you were always in fear for your life.. never give a statement to cops after incident and get a lawyer asap.
 
As my CCW instructor stated, "OMG I am still scared. It was so scary. I cant think straight. I need a lawyer before I taalk anymore about how scared I was and still am."
 
Lawyer up ASAP. Don't give any more info than enough to describe yourself and "I was in fear for my life." After that, the 5th amendment (if we still have a constitution???) is in full effect. You are immediately a suspect, and are under no legal obligation to make a statement without a lawyer. As far as warning shots, read my signature....
 
If i announce that i am armed and they keep coming, I AM in fear of my life because they have issues!
 
And my instructor said when asked how many times i shot, until the threat stopped coming or i ran out, never give a number.

My concealed instructor told me, If you are either in the right or wrong in shooting an killing an intruder, It is a minimum of $40k to lawyers etc. for them to either find you guilty or not. An that is if they don't fill a civil suit after the fact. If they do then well pony up some more doe. :eek: They are in the process of doing away with the civil suit if you the protector of your property is found innocent. The family of the intruder cannot bring up a civil case against you

Kid reaches for something and he shoots after being warned not to move. Only after this the girl tells her father that she did know him and in fact they were sleeping together prior. He did the best thing based on the information he was given. The boy's parents are up in arms about why he has not been arrested, etc. and I think they are threatening lawsuits.

I feel bad for the parents, but I would not hesitate to do the exact same thing....giving how protective fathers are towards their daughters in the first place... and the fact that the daughter was claiming that this boy is an intruder....
 
Break into my house you will most definately be found dead with a weapon. I can always find an old non matching screw driver from my toolbox and it will magically appear in dead fuckers hand....
