So where my question really is if you do not have reins and or a bridal are you technically operating said horse? Lets say your at the bar and had too much so you call home and Mr. Ed Walks on down and carries you home. You wouldn't get a DUI if your buddy was giving you a piggyback ride home.

It comes down to were you operating the horse? You need to be "operating" as part of the elements.
