Need advice or info: Facebook marketplace

So this happened back in November. I cut down a large ash tree beside the house. I put it up for sale on Facebook and a guy came and paid for it. I told him no rush on picking it up but after a few months I got aggravated. I've sent him a few messages asking when he planned to get it. The last message I received he said he had fallen ill and it would be a few weeks before he was back to normal. However, he said he would try to get someone up there to pick it up. So now it's going on 6 months and he still hasn't gotten the wood.

At this point, I know most folks would say to resale it or just put it on the corner with a free sign. However, I don't want any trouble with the law or being shut down from selling stuff on Facebook. Anyone run into this? I'm thinking of calling the police and give them the situation. Based on what they say I'll go from there. What caps this off is that I went on his Facebook page and saw where back in winter he was selling wood. So now I'm thinking he's using my house as a holding yard for his side business.
 
I have the same situation. Guy wanted two metal shed kits I have. Came and looked and put 1/2 down. Told him no hurry (). Now 3 1/2 months later, still setting hear....usually excuses. That one was I promise to get them next weekend. That was two weeks ago.
 
I was given the advice to never take a deposit because then you are obligated to hold, and can't sell an item to a would be cash in hand buyer....this advice has served me well lately.

If I were in your shoes, and I wanted to be 100% clean in this, I would offer the guy his cash back with 1 week to pick up the wood or his cash. After that, you are free to give the wood away.
 
Sell to someone else and give the guy his $ back and be done.
What if I can't get the same amount of money? It's not fall and i doubt people are that interested in firewood this time of year.
 
I would charge him rent. If he didnt want to pay. Keep your wood and your money..

This is his problem.

I don't want the wood. This just happened this morning and now I need the room to store it till I can get rid of it.

I don't see a problem taking a deposit. I have taken payments and/or deposits from people before that failed to complete the transaction. I have never had one ask for their money back because it was their fault for not paying. I got over $4k from one guy before he couldn't make payments anymore.

Worst case he tries to get his money back and sues you. At that point give it to him, but I doubt he would go that far for what I imagine would be a couple hundred bucks at most.
 
If you take a deposits for stuff, then someone else shows up and offers me more money for said item.....now you can't sell it and pass on a cash in hand sale. I had that happen a couple of times, and have avoided having it happen several times since implementing my "no deposits, and nothing is sold until cash is in hand" policy.

As for the wood....if 6 months has gone, sell it, give it away, whatever you feel is fair....offer money back, pick it up, and all offers expire Friday at noon.

Good luck man....when selling stuff, just remember most people suck!
 
I do non refundable deposits. Mainly because I value my time, and if they are going to waste my time it’s gonna cost them.
 
Sent the guy a message today saying he has 7 days. He responded with a sad face emoji. Wtf

I always say non-refundable, was taken to court by a douche who was on here . Came looked at items gave me half as a hold deposit. Signed paper saying non-refundable and had 90 days to pay rest or it would resold ..120 days later after 20 times tying to get him to call me or text i posted items for sale sold them same day. Almost 6 months later he contacts me wanting money back .. sorry money and itrms gone.
When we went to civil court they dismissed it because of signed paper saying 90 days and non-refundable.. fyi documents i used are free online

I followed up and told him to come get it to which he said he was done. "Keep the wood, keep the money, I'm done with you".

Do you think I should sell it again?
