This was exactly my point.
The insurance company is just an actor on behalf of the person. The company isn't liable, the person is liable, and the insurance covers the cost of the liability - or not, depending on what they policy is that was agreed to.
This is why its a big headache when the companies don't just go along with things amicably... you then have to deal with with a person in court.
Actually even if an insurance company does pay, they'll often go after someone else afterwards if they think they can hold them liable.
