Section 6: (from above link)

(6) (a) A person may operate an all-terrain vehicle on any two (2) lane public highway in order to cross the highway. In crossing the highway under this paragraph, the operator shall cross the highway at as close to a ninety (90) degree angle as is practical and safe, and shall not travel on the highway for more than two-tenths (2/10) of a mile.
(b) A person may operate an all-terrain vehicle on any two (2) lane public highway, if the operator is engaged in farm or agricultural related activities, construction, road maintenance, or snow removal.
(c) The Transportation Cabinet may designate, and a city or county government may designate, those public highways, segments of public highways, and
adjoining rights-of-way of public highways under its jurisdiction where all-terrain vehicles that are prohibited may be operated.
(d) A person operating an all-terrain vehicle on a public highway under this subsection shall possess a valid operator's license.
(e) A person operating an all-terrain vehicle on a public highway under this subsection shall comply with all applicable traffic regulations.
(f) A person shall not operate an all-terrain vehicle under this subsection unless the all-terrain vehicle has at least one (1) headlight and two (2) taillights, which shall be illuminated at all times the vehicle is in operation.
(g) A person operating an all-terrain vehicle under this subsection shall restrict the operation to daylight hours, except when engaged in snow removal or emergency road maintenance.

For upnover the way you were cited, as former LEO, seems a little odd to me. Parking lots of public places are treated same as roadways.
There is such a fine line as to what is an ATV and what is a truck I will talk to our county attorney (prosecuting attorney) and see what his feelings are on this and let you know.
For Gubni about silly question about drinking. Most people aren't very good liers. Most officers are trained to detect peoples body language when they are not telling the truth. Even though the officer knows most people are going to state that they are not drinking their body language may give it away that they are not truthful in their answer.
For everyone's information a person can be arrested for DUI anywhere in Kentucky. It does not have to be on a roadway.
If you are intoxicated and driving in the middle of Lion's Den you can be arrested for DUI. The legal limit in Ky. is .08%.
 
Thank you Ken for everything you do for the park. You might not remember, but several years ago, on our first trip to the park, you ran into us while I was running Upper rock garden backwards. You then spent the rest of the day showing us around the park. If it weren't for you showing us those trails, we wouldn't have been back so soon. Now we usually make a trip up there about once a month. I have been thru license checks up there and so far haven't been hassled by the officers. I will continue to use the park every chance I get, but if things get bad, will probably start staying on the putney side. Thanks again for all you do for the park and the county.

What if you put one of these on the back...and call it a tractor?

This sounds like the city government can make it legal for us to drive on the roads. Sure their are stipulations like always having headlights and tail lights on, a valid drivers license, no night useage. Basically sounds like while the mayor may be on our side to give us access, he hasn't taken the appropriate legal action to give us the right to use the roads.
 
I am guessing that is what he was referring to when he mentioned annexing the roadway. If it isn't in his city, I doubt there is much of anything he could do.

The city has an ordinance that follows what they are allowed to do by statue. There just happens to be that 8/10s of a mile on Bailey's creek that is not in the city. There is also the issue of, if a buggy is homemade is it a truck or ATV. Where you camp or stay doesn't make any difference to me, just as long as you do come and enjoy what we have.

I do remember you going the wrong way through can opener. I was impressed. I still tell people about it.

I would say they would have a tougher time..but wouldn't stop them from giving you a ticket if they really wanted to. You could prob get away with it in court, but who wants to go back to fight that fight.

(What is funny is my yota will have a 3 pt hitch setup so I can pull around plows, etc thru the woods at my property!)

Ken, Thanks for all that you do. We will be there soon. Now I just need to finish the paperwork on the buggy so it is licensed and registered. This is a push that I needed. You should see us there next weekend. Easy to find, just look for the safety orange buggy driving irradically.

My junk is legal, but I saw nobody being pulled or hassled last weekend. Now if someone would find out who stole my damn cell phone out of my truck, I'd be much happier. Stupid thing didn't even have service in Evarts. I sure hope the new owner enjoys it.:shaking:
 
why is it so hard to follow the law and actually have a plate and insurance. If you don't have a tag or insurance on your vehicle, keep it on the trailer and off the road. when happens when your pos hits another vehicle. Same as the uninsured mexican hitting somebody. that person gets screwed.

Wow, that was ignorant:shaking: The "law" hasn't been exactly clear for the past few years there, did you actually read the thread? My guess is you have never been there because you would know there isn't really a good place to park a trailered rig and alot of those "pos" you're talking about have over $20/30k in them. has any one been lately...looking to go for southern shine. hope i dont get pulled.
The law usually shows up for the big events and they don't seem to bother people on the not so busy normal weekends.. Might wanna take that into consideration when planning trips.

I personally try to avoid the big events now because the trails are jammed up with broken rigs.
 
well if its not street legal, insured and tagged, keep it off the road. Simple dmv rules. If you've got 20-30K in some of that junk then why can't you afford the tiny extra it would cost to make it legit.
 
Hey Einstein,how can you make it legal when they are custom built with no Vin #'s ??? You obviously have never been there to understand the layout of the place.
