It is privately owned and has been since 1983 when it became an aboard essement which means it reverted back to the landowners from the state. Not mention it IS hunting season here, which I live 20-25 minutes from the end of the RR trail. I’m also good friends with the landowners
There are reality signs for land that is for sale on this road. How would one access this land if they were going to purchase it? Asking for a friend...

The privately maintained gravel part where the trail comes out is what pissed off the land owners enough to close it completely the ‘volunteer effort’ really made it worse. They don’t want the Offroad community to get that ‘entitled feeling’

There were land for sale signs at the bottom end between pavement and trail last time I was down there in 2017
 
Your statement about those who did offer to help maintain the road, was not accepted by the landowners. Thevlandowners deciddd try did not want to feel as theyvowe the Offroad community for said help on the area

Did you came here to defend your buddies that are land owners? Do you know the so called land owners that were pointing guns at the friends of the OP?
 
I have seen this road/trail talked about for years and have never been to it. If it is truly private property then it can be legally gated and closed. If it's a public road then it's a public road. Why is there such grey area? ANYONE, landowners or others who are pointing guns at people are in the wrong if they aren't being threatened with the same threat and even though I've heard it said that the cops don't care, I have a hard time believing it.
Wouldn't a visit to the county records office be able to prove if it's legal or not?

you dont even have to leave your office/house. you can look any property on that counties GIS. Right of ways and roads are shown as well as property lines, and owners information and address of permanent address.

@GotWood if your friends could locate where they were on the trail/road they could very easily short list local land owners who would have been the most likely to confront them.
 
GIS website might have a link to the deeds of the properties. They should have recorded easements on them for the road. The easements will state the easement for public use. Probably need to get all parties on the same page before someone gets hurt.
If someone has a address for one of the properties, I can dig into it and see what is recorded in public record.

I like to go up there once or twice a year, so I've been following this Saga for a while.

Don't know if this helps beyond 'Knowledge is power', however, I don't have a lot to do today so... (edit: Noticed, 5 years later, I spelled knowledge wrong ...ironic)

As far as the validity of the ROW, according to Caldwell County; the Richlands Rd ROW does exist but stops about 1700' or .3 miles from the Watauga County line where it seems to follow a property line, for the most part, then picks back up as Penley Rd. at the County Line. To give those who've been there some frame of reference; the Bradshaw Cemetery and the Playground just beyond are well into Watauga County with the Penley Rd ROW running right through the middle.

All that to say;
As long as folk stay on the Rd there's only two property owners up there that have a legal right to say a word.

MICHAEL J WHITENER, who appears to live in Hickory

According to the tax cards both properties are vacant.

Dude what are you talking about?? The whole deal at tellico was over muddy water run off killing the habitat of the native trout.TU and other special interest/environmental groups threatened to sue and instead of giving everybody their day in court they caved and and shut the whole place down.

Don't recall all the details, but for Years the Robinson trail was ridden. Part of it was on National Forest land, the rest was Private property. But as the Forest Ser. Tried to Lie about the "Right-of-way", & wrote some tickets, The Court House records Proved the Trail was a Granted Legal Access road. That Stopped the FS from screwing riders, but a couples years after that, the Private Property land owners, gated their access sections. The only way to ride was to go in at the top on FS land, ride down to the Private Property, & turn back around. It was no longer contested, & CTB stopped riding there.

Seems like his buddies just want the area to themselves... I’m not far from Wheerever this is I promise I’ll make a weekend ride out if it comes about...
 
HuntWise app on iOS has land owner property lines also and shows your gps cords in relation to property lines has measuring tools in map also I use it when fishing and hiking through uncut trails...

How many off-road responsible community members do you know?? Bc 75% of em I know make trails and land better than when we get there... my rigs always have trash bags full after a day trip of riding even if I have to lose wheeling time! What entitlement do you speak of exactly? You came in like you have all the info so who’s the faggots the pointed firearms at someone? Care to share that part since your friends with them??

I'd really like to know as well.
My buddy @Paul mentioned something to me about riding through there and having a cookout that night.
Said hed bring the beer and steaks and I needed to bring my bobcat, some lime "several bags worth", a blow torch, razor blades, lemon juice, and he had another buddy bringing a wood chipper..

I aint got no idea what kinda recipe Paul has in mind but I'm always down for the party.
